Item 08E <br />Page 2of7 <br />MN Statute §346.39, Subd 4 (Shelter size) requires a minimum confinement area measuring <br />from the tip of a dog's nose to the base of its tail, + 25%. For example, a Great Dane (24" — 32" <br />length) would require a minimum confinement area of 40" X 40" (11 sq ft). The proposed <br />outdoor kennel area is about 900 sq ft in area. <br />The applicant stated during the Public Hearing that the outdoor kennel area will be fenced, and <br />include a grass surface. Dogs would be accompanied at all times. Fesses would be stored in a <br />trash can. Deodorizer would be used as necessary. <br />The applicant stated during the Public Hearing that he intends to board 5 — 10 dogs, and <br />conduct training services. Dogs may be boarded up to 6 hours overnight without supervision, <br />but would be monitored via security cameras. <br />The applicant has not submitted plans regarding the interior of the building (e.g. kennel size, <br />type of flooring, ventilation, etc.). <br />For comparison, Mounds View Animal Hospital offers boarding (indoor & outdoor). Outdoor <br />kennels are fenced (including top), and have a concrete surface, in addition to a grass exercise <br />area. The outdoor kennel area is similarly adjacent to an apartment/townhome complex (0' <br />setback to property line and adjacent to playground, 65' setback to townhome building). <br />Analysis: <br />The property is zoned B-2 Limited Business. Within B-2, an Animal Boarding Facility (along <br />with Veterinary Clinics)2 requires a Conditional Use Permit (CUP). There are six conditions, <br />primarily relating to having adequate indoor ventilation and not creating a nuisance when <br />outdoors. <br />(1) Noise and odor are effectively confined to the premises in accordance with Ch. 91 of <br />this code of ordinance; <br />Chapter 91: Health and Sanitation; Nuisances; "Accumulations of manure or rubbish" is <br />a public nuisance (Mounds View City Code §91.003 (A)(4). <br />(2) A mechanical ventilation or exhaust system shall be installed to control, capture and <br />remove emissions or odors generated by the use. The systems shall be separate from <br />other ventilation systems in the building. The system shall be designed to prevent the <br />migration of emissions or odors to other parts of the building. Installation must comply <br />with Minnesota Building Code Mechanical Systems, Ch. 1346 [Chapter 1346; Minnesota <br />Mechanical and Fuel Gas Codes]; <br />(3) All animal boarding activities shall be conducted indoors, except for necessary outdoor <br />exercise. At no time shall any animal be left unsupervised while outdoors; <br />(4) Outdoor exercise shall be conducted so as not to unreasonably annoy, injure or <br />endanger the health, safety, comfort or welfare of the public; <br />z Mounds View City Code 160.012 (Definitions): ANIMAL BOARDING FACILITY. A commercial establishment in <br />which domesticated animals are housed for a fee or compensation.
