RESOLUTION 9653 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION DENYING APPLICATION TO AMEND THE OFFICIAL ZONING MAP <br />FOR 2310 MOUNDS VIEW BOULEVARD, FROM R-1 SINGLE FAMILY <br />RESIDENTIAL TO PUD PLANNED UNIT DEVELOPMENT <br />(PLANNING CASE MU2022-003) <br />WHEREAS, Reuter Walton, (the "Applicant") submitted three applications dated (October <br />10, 2022) for the property identified as PID: 08-30-23-31-0075, and that is located at 2310 Mounds <br />View Boulevard (the "Property") as the Applicant seeks to construct a 140-unit apartment building to <br />be located at the Property; and <br />WHEREAS, the first application requests a rezoning of the Property through a Zoning Map <br />Amendment to rezone the Property from R-1 Single Family Residential to PUD Planned Unit <br />Development; and <br />WHEREAS, the second application requests approval of a preliminary plat regarding the <br />Property; and <br />WHEREAS, the third application requests approval of a planned unit development ("PUD") <br />and Development Review of the Property; and <br />WHEREAS, the Applicant extended the City's timeline to consider the application under <br />Minn. Stat. § 15.99 until February 10, 2023; and <br />WHEREAS, on November 2, 2022, the Planning and Zoning Commission reviewed the <br />applications and recommended approval; and <br />WHEREAS, the City Council held public hearings on the applications, after providing <br />the appropriate notice, on November 28,2022, and which were continued until December 12, <br />2022 to allow time for the Developer to clarify and complete a traffic study, parking study, <br />address exterior lighting, tree preservation, and a needs analysis; and <br />WHEREAS, at the December 12, 2022 meeting of the City Council, a motion was made <br />to approve the Zoning Map Amendment, but said motion failed to move forward due to the lack <br />of a second; and <br />WHEREAS, the City Council subsequently approved a motion to deny the rezoning <br />application and directed staff to draft a written statement of the reasons for the denial in <br />accordance with Minn.
