Resolution 9653 <br />Page 2 of 3 <br />WHEREAS, the City Council also moved to table the action on the Preliminary Plat and <br />PUD and Development Review until the written statement for denial of the Zoning Map <br />Amendment could be considered by the City Council at its regular meeting scheduled on <br />December 27, 2022; and <br />WHEREAS, the City Council hereby finds and determines as follows with respect to the <br />denial of the Applicant's requests: <br />a. The Property is currently zoned R-1 Residential. <br />b. The rezoning of land is a policy decision the City Council must make upon considering a <br />number of factors, including, but not necessarily limited to, the zoning of surrounding <br />land, the types of uses that will be allowed on the land if it is rezoned, the impacts of <br />those uses in the area given the surrounding uses and the ability of the public <br />infrastructure and services to accommodate those uses; <br />c. The proposed use of the Property is rezoned as requested would conflict with the <br />residential uses in the area, including those residential uses that are directly to the east <br />and west of the Property and in other locations nearby; <br />d. The proposal requires too many deviations from the standards for planned unit <br />developments that are established in the City Code, including the following: <br />i. Increased density; <br />ii. Reduction in usable open space; <br />iii. Elimination of trees on the project site; <br />iv. Reduction in available parking from the established standard; <br />V. Reductions in setbacks; and <br />vi. Deviation from external building materials standards; <br />e. Rezoning of the Property from R-1 Single Family Residential to PUD Planned Unit <br />Development is not, for the reasons stated herein, in the best interests of the City or the <br />public health, safety, and welfare; <br />f. Having determined that rezoning the Property, as requested, is not appropriate, the <br />request to approve a preliminary plat for the Property to accommodate the 140-unit <br />apartment building, must also be denied; and <br />g. Having determined that rezoning the Property, as requested, is not appropriate, the PUD <br />and Developmental Review must also be denied. <br />NOW, THEREFORE, BE IT RESOLVED, by the city council of the City of Mounds <br />View, as follows: <br />1.
