Mounds View City Council December 27, 2022
Regular Meeting Page 3

addresses the complaints that have been brought to the City and how future complaints will be
addressed by the Council.

Council Member Meehlhause noted there were two typographical errors in the Resolution. He
requested staff correct these grammatical errors.

MOTION/SECOND: Meehlhause/Cermak. To Waive the Reading and Adopt Resolution 9682,
Approval of Business License Renewal – Curbside Waste, Inc.

Council Member Hull questioned how the City would address complaints going forward. Assistant
City Attorney Sathe reported if a licensee fails to abide by the terms of the license and City Code,
the City can move forward with suspension and revocation. He explained City Code requires that
the Council provide an opportunity for the license holder to be heard before the Council can take
action to suspend or revoke the business license.

City Administrator Zikmund indicated any complaints have to have verifiable evidence from staff,
whether this be from administrative staff, code enforcement or the police department.

Mayor Mueller reported it was difficult to consider this action knowing it would have impacts on
Mounds View residents, but she did not see any other way to get a message across to the license
holder that they must follow the City Code noise ordinance rules. She hoped Curbside Waste
understood the rules in Mounds View were serious.

Council Member Bergeron believed the Council was acting in good faith that Curbside Waste
would be following the contract as well as City Code going forward.

Mayor Mueller explained two weeks ago the City Council approved all of the business licenses in
the City for 2023, with the exception of the business license for Curbside Waste. She reported
action was delayed to this meeting to ensure staff could speak with Curbside Waste about
complaints the City had receive regarding hours of operation/noise concerns.

Deon Richardson, Curbside Waste representative, noted he had been communicating with City
Administrator Zikmund and explained the noise complaint concern had been addressed. He
reported Curbside Waste trucks now have cameras and GPS which meant any future complaints
could be addressed immediately. Mr. Richardson apologized for the driver that was starting work
at 6:00 a.m. and noted this would not occur in the future.

Ayes – 5 Nays – 0 Motion carried.

B. Approval of 2023 NYFS Contracts.

City Administrator Zikmund requested the Council approve the 2023 contracts with Northeast
Youth and Family Services (NYFS).

Council Member Meehlhause reported NYFS has been serving the community for the past 45 years
and Mounds View has been one of the municipal partners since the organization began.
