MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION 1143-21 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION RECOMMENDING APPROVAL OF <br />THE INTENT OF THE CITY OF MOUNDS VIEW TO DISPOSE OF PROPERTY; <br />4889 OLD HIGHWAY 8, AND 4943 OLD HIGHWAY 8, <br />IN COMPLIANCE WITH THE COMPREHENSIVE PLAN <br />WHEREAS, in 1996, the City of Mounds View purchased real property located at 4943 Old <br />Highway 8, for the purposes of realigning Old Highway 8; and, <br />WHEREAS, in 2018, the City of Mounds View Economic Development Authority (EDA) <br />purchased real property located at 4889 Old Highway 8, for the purposes of redevelopment (Resolution <br />18-EDA-318); and, <br />WHEREAS, in 2020, the City of Mounds View EDA acquired real property, commonly known <br />as a 33' Highway Easement in-between 4889 Old Highway 8, and 2151 Mustang Drive (Second Judicial <br />District Court, File No. 62-CV-1080); and <br />WHEREAS, in 2021, the City of Mounds View EDA entered into a Purchase and Development <br />Agreement with Bio-Clean Mobile Wash Inc. (2151 Mustang Drive), to purchase the 33' Highway <br />Easement, and a portion of 4889 Old Highway 8 for the purposes of expanding the Bio-Clean facility <br />(Resolution 21-EDA-342); and, <br />WHEREAS, in 2021, the City of Mounds View EDA entered into a Purchase and Development <br />Agreement with MWF Properties, LLC to purchase the remainder of 4889 Old Highway 8, for the <br />purposes of redeveloping the site for workforce housing (Resolution 21-EDA-341). The EDA intends to <br />include real property located at 4943 Old Highway 8 (remaining land, after road realignment) as part of <br />this Preliminary Development Agreement; and, <br />WHEREAS, Minnesota Statute §462.356, Subd 2 states; ..... "[N]o publicly owned interest in <br />real property within the municipality shall be acquired or disposed of, nor shall any capital improvement <br />be authorized by the municipality..... .....until after the planning agency has reviewed the proposed <br />acquisition, disposal, or capital improvement and reported in writing to the governing body..... .....its <br />findings as to compliance of the proposed acquisition, disposal or improvement with the comprehensive <br />municipal plan "..... <br />NOW, THEREFORE, BE IT RESOLVED in consideration of the proposed development <br />projects, the Comprehensive Plan, and Staff Report, the Planning and Zoning Commission (Planning <br />Agency) makes the following Findings (italics); <br />Land Use Goals and Policies <br />Goal 1: Stabilize and strengthen neighborhoods <br />
