MOUNDS VIEW PLANNING COMMISSION RESOLUTION 1143-21 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE INTENT OF THE CITY OF MOUNDS VIEW TO DISPOSE OF PROPERTY; 4889 OLD HIGHWAY 8, AND 4943 OLD HIGHWAY 8, IN COMPLIANCE WITH THE COMPREHENSIVE PLAN WHEREAS, in 1996, the City of Mounds View purchased real property located at 4943 Old Highway 8, for the purposes of realigning Old Highway 8; and, WHEREAS, in 2018, the City of Mounds View Economic Development Authority (EDA) purchased real property located at 4889 Old Highway 8, for the purposes of redevelopment (Resolution 18-EDA-318); and, WHEREAS, in 2020, the City of Mounds View EDA acquired real property, commonly known as a 33' Highway Easement in-between 4889 Old Highway 8, and 2151 Mustang Drive (Second Judicial District Court, File No. 62-CV-1080); and WHEREAS, in 2021, the City of Mounds View EDA entered into a Purchase and Development Agreement with Bio-Clean Mobile Wash Inc. (2151 Mustang Drive), to purchase the 33' Highway Easement, and a portion of 4889 Old Highway 8 for the purposes of expanding the Bio-Clean facility (Resolution 21-EDA-342); and, WHEREAS, in 2021, the City of Mounds View EDA entered into a Purchase and Development Agreement with MWF Properties, LLC to purchase the remainder of 4889 Old Highway 8, for the purposes of redeveloping the site for workforce housing (Resolution 21-EDA-341). The EDA intends to include real property located at 4943 Old Highway 8 (remaining land, after road realignment) as part of this Preliminary Development Agreement; and, WHEREAS, Minnesota Statute §462.356, Subd 2 states; ..... "[N]o publicly owned interest in real property within the municipality shall be acquired or disposed of, nor shall any capital improvement be authorized by the municipality..... .....until after the planning agency has reviewed the proposed acquisition, disposal, or capital improvement and reported in writing to the governing body..... .....its findings as to compliance of the proposed acquisition, disposal or improvement with the comprehensive municipal plan ".....
