Are you <br />available tomorrow morning? <br />I think I understand what Brian is trying to argue, but I do not see that the "council" has made any official request under <br />the statute, and even if that occurred, the argument is an overly restrictive reading of the statutes. Brian appears to <br />believe that no interaction can occur between a city council and a charter commission without invoking a statutory <br />process. No other charter commission that I work with operates in such a fashion. <br />Let's talk tomorrow. <br />Thanks. Scott J. Riggs <br />Kennedy & Graven, Chartered <br />From: Nyle Zikmund <nyle.zikmund@moundsviewmn.org> <br />Sent: Tuesday, March 23, 2021, 8:11 PM <br />To: Riggs, Scott J. <br />Cc: Nyle Zikmund <br />Subject: Legal question on charter <br />Brian Amundsen stated tonight that if the City Council "sends" and item to the Commission for consideration, and they <br />send it back, then council unanimous vote is irrelevant, that it has to go to the voters. <br />Chair Warren clarified that he has not seen an "official request" from the mayor or council, rather a presentation by <br />Director Beer. It is also part of our strategic plan but I think that is a reach to say that is a council request. <br />First I have heard that a request from the council, to the commission, back to the council — has to go to the voters. <br />Brian stated it is only charter commission initiated items that can be approved by unanimous council that then do not <br />need to go to the voters. <br />Need to know what the "facts" are when it comes to changing the charter. <br />Nyle Zikmund <br />City Administrator <br />
