92 . 01 <br /> CHAPTER 92 <br /> TREE DISEASES <br /> 92 . 01 Program of Plant Pest Control . The Clerk-Administrator, <br /> and those agents appointed by him, are hereby empowered to conduct <br /> a program of plant pest control pursuant to authority granted by <br /> the Minnesota Statutes , Chapter 18 . 022 and 18 . 023 . The program is <br /> directed specifically at the control and elimination of Dutch Elm <br /> disease fungus , elm bark beetles , Oak Wilt fungus , and other <br /> epidemic diseases of trees . <br /> 92 . 02 Inspection and Investigation. The Clerk-Administrator <br /> or his agents : <br /> (1) Shall inspect all premises and 'places within the City <br /> as often as practicable, but not less than that required by the <br /> State of Minnesota, to determine whether any condition described <br /> in Chapter 92 . 03 exists thereon . He shall investigate all incidents <br /> of infestations by Dutch Elm fungus , elm bark beetles , Oak Wilt <br /> fungus , or any other epidemic diseases of trees , and such factors <br /> which are potentially contributory to the spread of tree diseases ; <br /> (2) May enter upon private premises at any reasonable time <br /> 1111, for the purposes of carrying out any of the duties assigned him <br /> under this Chapter; <br /> (3) Shall upon finding conditions indicating Dutch Elm <br /> infestation, Oak Wilt infestation, or other epidemic diseases of <br /> trees, immediately send appropriate specimens or samples to the <br /> diagnostic laboratory operated by the Commissioner of Agriculture <br /> for analysis , or take such other steps for diagnosis as may be <br /> recommended by the Commissioner . <br /> 92 . 03 Nuisances Declared. It is unlawful for any person <br /> to permit public nuisances , as herein defined, to remain on any <br /> premises owned or controlled by him within the City. <br /> The following are hereby declared public nuisances whenever <br /> they may be found within the City: <br /> (1) Any living or standing Elm tree or part thereof infected <br /> to any degree with the Dutch Elm disease fungus Ceratocystis Ulmi <br /> (Buisman) Moreau or which harbors any of the elm bark beetles <br /> Scolytus Multistriatus (Eichh. ) or Hylurgopinus Rufipes (Marsh) ; <br /> (2) Any dead or dying Elm tree or part thereof , including <br /> logs, branches , stumps , firewood, or other Elm material from which <br /> the bark has not been removed , and burned or buried; <br /> 41It (3) Any living or standing Oak tree or part thereof , infected <br /> to any degree with the Oak Wilt fungus Ceratocystis fagacearum; <br />
