I believe that I have
covered all of the items set forth in your March 1, 1995 letter. To answer the
question in paragraph 7 of your letter, the city would not be legally required to
enter into similar agreements with other groups.
You might want to check with other municipalities to see if any have entered into
Similar type arrangements. One potential problem that you might anticipate is that
the perception will be that the building is owned by the city. Consequently, other
groups that use the same ballfields might expect to be able to use the building for
storage of their own equipment. I do not know whether other cities have faced this
problem. I suspect that in most cases the city itself has constructed buildings such
as this, and allowed various groups to use them for storage.
One question that you should ask the Association is whether they intend to obtain
a mortgage on the property to finance the construction. Perhaps they are financing
it solely from their own resources, but you should know which way it is.
There are still several blanks that need to be completed in the agreement and it
should be understood that at this stage it is still a preliminary draft.
Please call me if you have any questions.
Sincere' ,
4/0 Thomson
•
J.7T/Imb
Enclosure
JJT&5575
11125-13
