• <br /> b Berkley Risk Services, Inc. <br /> April 13, 1995 <br /> Mr. Donald Brager (FAX #: 784-3462) <br /> Finance Director <br /> City of Mounds View <br /> 2401 Highway 10 <br /> Mounds View, MN 55112-1499 <br /> Dear Mr. Brager: <br /> This letter will confirm our recent conversation concerning the Cub Scouts collecting aluminum <br /> cans on city park property. This service is provided to you through the City's participation in the <br /> League of Minnesota Cities Insurance Trust (LMCIT) property and casualty program. <br /> We do have some real concerns for the health and safety of the youngsters in addition to the <br /> liability exposure for the City of Mounds View. There are some real concerns exposing minors <br /> to some of the hidden dangers which could be encountered from separating the aluminum from <br /> other assorted trash. These hidden dangers could include sharp objects such as needles, insects, <br /> • bodily fluids, and other assorted articles. <br /> With the aforementioned in mind, it is highly advisable the city keep the following controls in <br /> place. <br /> 1-4/95 All youngsters should be highly supervised by adults whenever they engage in collection <br /> and/or separation activities. The adults should have basic training in hazard recognition <br /> and procedures should be developed to ensure the safety of the youngsters. <br /> 2-4/95 Waivers of liability should be signed by the parent or guardian of each minor participant. <br /> The waiver should be structured in such a way to provide appropriate warning with a <br /> hold-harmless statement. An appropriate attorney should be involved in the drafting of <br /> such waivers. <br /> 3-4/95 A written contract should be developed between the scout pack and the City of Mounds <br /> View. Appropriate Cub Scout representatives should be signing this contract and the <br /> parent of each participant should also sign the contract. The contract in part should have <br /> a proper hold-harmless/ indemnification paragraph in favor of the city. Additionally, <br /> the contract should reference policies and procedures, as well as appropriate safety <br /> equipment. An appropriate attorney or the League of Minnesota Cities Insurance Trust <br /> staff attorney should be involved with the drafting of such a contract. <br /> • 4-4/95 Typically, it is also advisable for the city to obtain a certificate of insurance and an <br /> endorsement naming the City of Mounds View as an additional insured. This certificate <br /> can help protect the city in a number of instances.
