April 13, 1995 Mr. Donald Brager (FAX #: 784-3462) Finance Director City of Mounds View 2401 Highway 10 Mounds View, MN 55112-1499 Dear Mr. Brager: This letter will confirm our recent conversation concerning the Cub Scouts collecting aluminum cans on city park property. This service is provided to you through the City's participation in the League of Minnesota Cities Insurance Trust (LMCIT) property and casualty program. We do have some real concerns for the health and safety of the youngsters in addition to the liability exposure for the City of Mounds View. There are some real concerns exposing minors to some of the hidden dangers which could be encountered from separating the aluminum from other assorted trash. These hidden dangers could include sharp objects such as needles, insects, • bodily fluids, and other assorted articles. With the aforementioned in mind, it is highly advisable the city keep the following controls in place. 1-4/95 All youngsters should be highly supervised by adults whenever they engage in collection and/or separation activities. The adults should have basic training in hazard recognition and procedures should be developed to ensure the safety of the youngsters. 2-4/95 Waivers of liability should be signed by the parent or guardian of each minor participant. The waiver should be structured in such a way to provide appropriate warning with a hold-harmless statement. An appropriate attorney should be involved in the drafting of such waivers. 3-4/95 A written contract should be developed between the scout pack and the City of Mounds View. Appropriate Cub Scout representatives should be signing this contract and the parent of each participant should also sign the contract. The contract in part should have a proper hold-harmless/ indemnification paragraph in favor of the city. Additionally, the contract should reference policies and procedures, as well as appropriate safety equipment. An appropriate attorney or the League of Minnesota Cities Insurance Trust staff attorney should be involved with the drafting of such a contract. • 4-4/95 Typically, it is also advisable for the city to obtain a certificate of insurance and an endorsement naming the City of Mounds View as an additional insured. This certificate can help protect the city in a number of instances. However, in this instance it may not be the most practical approach.
