(1) The subdivider of any tract of land which is to be <br /> developed for residential uses nay be required by the <br /> City Council to nuke a cash contribution according <br /> to the following density per acre and percentage <br /> table. <br /> Dahsity Maximum Dedication Per <br /> Acre as a Percentage <br /> of Fair Market Value <br /> of Undeveloped rand <br /> 0 Dwelling units per acre 3 <br /> 2.1 Dwelling units per acre 4 <br /> 3.1 Dwelling units per acre 5 % <br /> 4.1 Dwelling units per acre 6 <br /> 5.1 or more Dwelling units per acre 10 <br /> (2) The subdivider of any parcel of land zoned single family <br /> residential, which has located thereon (1) single family <br /> dwelling, and who subdivides said parcel into additional <br /> lots, shall receive a credit for the existing single <br /> family dwelling unit by excluding the acreage of the <br /> occupied parcel, remaining after subdivision, from <br /> the computation of density in applying the provisions of <br /> Section 309.030 (L') (1) . <br /> • (3) The sliYiivider of any tract of land which is to be developed <br /> for commercial or industrial uses may be required by the <br /> City Council to nal;_ a cash contribution in an amount not <br /> to exceed ten (10=6) percent of the fair market value of <br /> the undevelo_ed land at the time of the final plat or minor <br /> subdivision approval. <br /> (4) Uhere a cash contribution is required in lieu of a land <br /> dedication, the City Manager shall appoint a real estate <br /> appraiser, licensed by the State of Minnesota to determine <br /> the fair market value of the undeveloped land at the time <br /> of final plat or minor subdivision approval, which <br /> determination shall be conclusive for purposes of this <br /> Ordinance. The subdivider shall be advised as to the costs <br /> of securing the appraisal and shall remit the appraisal <br /> costs to the City before final plat or minor subdivision <br /> approval. <br /> The City Manager may waive the requirements of this sub- <br /> division if the City has available to it current market data <br /> • sufficient to enable the City Staff to determine fair market <br /> value of the undeveloped land at the tixe of final plat or <br /> minor subdivision approval. <br /> 111( <br />
