r <br /> ORDINANCE NO. 391 <br /> PAGE FOUR <br /> ( 5 ) The event or activity shall be conducted and <br /> controlled in such a manner so as not to con- <br /> stitute a hazard to or a source of nuisance or <br /> annoyance to other persons in the park or on • <br /> adjacent property. <br /> ( 6 ) All rubbish, trash and debris shall be removed <br /> from the park and disposed of by the organiza- <br /> tion promptly at the conclusion of the event <br /> or activity. The organization shall be re- <br /> sponsible for all clean-up expenses. <br /> ( 7 ) Only non-glass containers are permitted. <br /> Subdivision 8 . Cancellation of Permit. If , at any <br /> time following the issuance of the permit , the City <br /> Parks and Recreation Director or the Chief of Police <br /> conclude that the sale of beer for which the permit <br /> was granted may be detrimental to the public health, <br /> safety or welfare , or may result in violation of <br /> statutes or ordinances relating to the sale of alco- <br /> holic beverages, or not adequately controlled by the <br /> organization, then shall recommend to the Council <br /> that the permit be cancelled. <br /> The Council shall consider the recommendation at its <br /> • <br /> next regularly scheduled Council meeting occurring <br /> no less than five days from the date of such recom- <br /> mendation. The Council may cancel the permit, allow <br /> it to continue in effect or modify the permit. <br /> If the event has commenced, or if sufficient time <br /> does not exist to bring the matter before the Coun- <br /> cil , the City Parks and Recreation Director, in <br /> cooperation with the Chief of Police , may act to <br /> revoke the permit. If the permit is revoked, while <br /> the activity is in progress , police officer shall <br /> notify the person in charge of the sale of beer of <br /> such revocation. Upon notification , the organiza- <br /> tion shall cease the sale of beer and shall remove <br /> all unsold beer from the park. The organization <br /> shall assist in the restoration of order in the park <br /> and shall , cancel the event or activity. <br /> SECTION III . Chapter 52.03.
