42 .11 <br /> • <br /> Subdivision 2. Exceptions. The foregoing requirements in <br /> Subdivision 1 may be waived by the Council, if after study and r <br /> recommendation by the Planning Commission that (1) and/or (2) <br /> below are applicable to the proposed subdivision: <br /> (1) The placing of electric and telephone utilities under- <br /> ground would not be compatible with the development <br /> planned. <br /> (2) Unusual topography, <br /> soil, or other physical conditions <br /> make underground installation unfeasible from an engi- <br /> neering viewpoint or the cost impractical. <br /> 42.11 SOIL TESTS. Upon the advice of the City Engineer the <br /> Council may require soil tests prior to the approval of the <br /> final plat. Such test holes, when ordered by the City authorities;, <br /> shall be drilled at the expense of the owner or developer and <br /> the information disclosed shall be furnished to the Council <br /> together with a copy of the proposed plat showing the location <br /> of each test hole, the information as to the various types of <br /> soil encountered and their depths, the level of the ground water <br /> and a seepage test and may include additional information. The <br /> number of test holes to be drilled and their location on the <br /> property which is proposed to be platted will be as directed <br /> by the Council or their authorized representative. <br /> 42 . 12 PUBLIC SITES, PARKS AND PLAYGROUNDS. Where a proposed <br /> park, playground, school site or other public site as shown on <br /> the Comprehensive Plan or Open Space Master Plan is embraced <br /> in part or in whole by the boundary of a proposed subdivision <br /> and such public sites are not dedicated to the Municipality or <br /> Board of Education, such public ground shall be reserved and no <br /> action taken toward approval of a subdivision- for a period not <br /> to exceed ninety (90) days to allow the Council or Board of <br /> Education the opportunity to consider and take action toward <br /> acquisition of such public ground or park by purchase or other <br /> means. <br /> 42 .13 PARKS AND PLAYGROUNDS DEDICATION. <br /> Subdivision 1. Dedication Required. <br /> (1) Pursuant to Minnesota Statutes 462. 358, in all subdivisions <br /> to be developed for residential, commercial, industrial <br /> or other uses, or as a planned development which includes <br /> residential, commercial and industrial uses, or any <br /> combination thereof, a reasonable portion of each pro- <br /> posed subdivision shall be dedicated to the public for <br /> public use as parks , playgrounds , public open space, or <br /> storm water holding areas or ponds , or, at the option <br /> " of the Municipality, at its sole discretion, that the ( 1� <br /> subdivider contribute an equivalent amount in cash based <br /> on the fair market value of the undeveloped land. <br />
