MEMO TO: Parks and Recreation Commissioners <br /> FROM: Mary Saarion, Director <br /> • Parks, Recreation and Forestry <br /> DATE: 13 , <br /> August 1987 <br /> g <br /> RE: Silver View Pond Pathway <br /> A petition was recently received from residents of the Silver View <br /> Park pond area. A copy of the petition is enclosed. City Attorney <br /> Richard Meyers and City Clerk-Administrator Donald Pauley have been <br /> consulted on this matter. It is Attorney Meyers recommendation that <br /> the pathway be completed for liability reasons. It is recommended <br /> that the City should not consider the sale of the property. <br /> Furthermore, Attorney Meyers recommends that the concerned residents <br /> receive a 30 - 60 day notice of the cities intentions to construct <br /> the pathway. The City is willing to consider a reasonable <br /> agreement with the residents to address concerns with amenities such <br /> as landscaping. <br /> The history of this park development shows the original plans for a <br /> continuous trail around the entire pond. The park design maps and <br />• plans were initiated in 1979 - 1980. In 1981 a park referendum was <br /> on the general election ballot. At that time, park amentities <br /> throughout the City were planned including a bridge to connect the <br /> two paths around the pond. These amenities were dependent upon the <br /> success of this referendum. The referendum failed and the result <br /> was that plans for the five year capital improvement plan were <br /> • <br /> unobtainable due to lack of funds. <br /> During this 1981 park referendum campaign, the lots and homes in <br /> the Mary Anderson development were being sold and developed. The <br /> sales campaigns included the Park Master Plans, a concern of the <br /> buyers. Unfortunately, the plans were never realized <br /> because of the failed park referendum. <br />• <br /> Although the park referendum failed, the development of the parks <br /> cannot halt. New plans must be developed to utilize the parks for <br /> the purpose intended. The plans for a pathway around Silver View <br /> Pond need not die. The solution of foregoing an expensive bridge <br /> and continuation of the chipped wood pathway around the pond is an <br /> inexpensive and feasible alternative to offer the people a <br /> continuous looped trail around the community park. <br /> It has been indicated that a verbal promise may have been made <br /> by former Director Anderson that the path would not extend <br /> continuously around the pond. However, this was contingent that the <br /> bridge would be affordable with the success of the Park Referendum. <br /> Written agreements on this matter have not been obtainable by the <br /> residents , Mary Anderson Homes or City files. <br />
