RESOLUTION NO. 9757 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING OR DENYING DRIVEWAY VARIANCES <br />RELATED TO THE 2023 STREET PROJECT <br />WHEREAS, the City will reconstruct streets in Area K in 2023; and, <br />WHEREAS, Mounds View City Code §160.338(E) (Curb cut widths) states; "In <br />conjunction with street improvement projects or in conjunction with individual driveway <br />replacement projects, non -conforming curb cuts shall be made conforming to whatever extent <br />practicable. If, in the opinion of the Directors of Public Works/Parks and Recreation and <br />Community Development, a non -conforming curb cut cannot be made conforming without <br />undue hardship or disruption to the property, the curb cut may remain in existence, unchanged. <br />Decisions regarding curb cuts may be appealed in writing to the City Council. " <br />WHEREAS, on August 21, 2023, City Staff mailed a notice to property owners of non- <br />conforming driveways, including the City's intent to reinstall curb cuts to be conforming to City <br />Code. The April letters included a deadline of May 15, 2023 to apply for a Variance. Staff <br />inspected non -conforming driveways on May 25, 2023, speaking to many homeowners, and <br />accepting verbal Variance requests; and, <br />WHEREAS, of seven non -conforming driveways found, four homeowners have <br />requested Variances; and, <br />NOW, THEREFORE BE IT RESOLVED THAT the Mounds View City Council has <br />reviewed appeals submitted by property owners, and takes the following action: <br />Address <br />Property Owner <br />Request <br />Approved <br />Denied <br />7775 <br />Spring Lake Rd <br />Hoang Tran <br />Keep as -is; 0' setback <br />7785 <br />Spring Lake Rd <br />Scott Hinrich <br />Keep as -is; apron to match <br />width of driveway at street <br />7830 <br />Spring Lake Rd <br />Dan & Michelle <br />2nd curb cut to allow <br />Dreier <br />parking area between trail <br />and trees.
