Honorable Mayor and City Council Members <br />July 21, 2023 <br />Page 4 <br />The City has already passed the required resolution, Resolution 9694, and received legislative approval <br />Minnesota Laws 2023, Regular Session, Chapter 64, Article 10, Section 41. In order to hold the election <br />in 2023, the City must do the following: <br />1. Hold a Referendum <br />a. To present the question of local sales tax approval to voters in 2023, the City must call a <br />special election to be held at the same time as the general election in November 2023. <br />This can be accomplished by passing a resolution doing the following: <br />Adopt a resolution calling for a special election and confirming the ballot title and <br />ballot question. <br />1. Title must be 10 words or less, approved by a jurisdiction's legal counsel. <br />b. The City Council must provide notice to the County Auditor and Minnesota Secretary of <br />State by August 25, 2023. <br />c. At least 2 days in advance of testing voting system, publish notice in official newspaper <br />of time and place of test. <br />d. At least 14 days (October 24) before election day: <br />i. test voting system <br />ii. post sample ballot at the city clerk's office <br />e. At least 10 days (October 28) before election: post notice of the election date, voting <br />hours, poling location, and question to be voted on. Must be posted at the office of the <br />City Clerk. <br />f. Election day: <br />i. Post sample ballot at each polling location. <br />g. Between 3rd and 10a' day after election: <br />i. City Council meets as canvassing board to declare results of election. <br />2. The City must file local approval with the Minnesota Secretary of State prior to the start of the <br />next regular legislative session.' <br />Min. R. 8250.1810, Subp. 10. <br />$ See Minn.
