9r3 <br /> CHAPTER 153: TREES <br /> Section <br /> Shade Tree Disease and Pest Control <br /> 153.001 Shade Tree Disease and Pest Control Program <br /> 153.002 Inspection and investigation <br /> 153.003 Nuisances declared; abatement <br /> 153.004 Abatement procedures; assessment of costs <br /> 153.005 Disruption of root grafts <br /> 153.006 Treating of trees <br /> 153.007 Transporting wood; permitting requirements <br /> 153.008 Storage of elm wood <br /> 153.009 Tree contractors; licensing requirements <br /> 153.999 Penalty <br /> SHADE TREE DISEASE AND PEST CONTROL <br /> § 153.001 SHADE TREE DISEASE AND PEST CONTROL PROGRAM. <br /> (A) Authority. The City Administrator and those agents appointed by the City Administrator (herein <br /> referred to as "Tree Inspector") are hereby empowered to conduct a program of shade tree disease <br /> and pest control pursuant to authority granted by M.S. §§ 18G, 89.001, 89.01 and 89.51 through <br /> 89.64, as they may be amended from time to time, including the elimination of Dutch elm disease <br /> fungus, elm bark beetles, oak wilt fungus, emerald ash borer and other potentially non-native invasive <br /> pests and epidemic diseases of trees. <br /> (B) Interference prohibited. It shall be unlawful for any person to interfere, prevent or delay the <br /> authorized parties from discharging their duties pursuant to this subchapter. <br /> (Prior Code, § 605.01) (Ord. 844, passed 5-20-2010; Ord. 871, passed 05-03-2012) Penalty, see § <br /> 153.999 <br /> § 153.002 INSPECTION AND INVESTIGATION. <br /> (A) Inspection. The Tree Inspector shall inspect all premises and places within the city as often as <br /> practicable, but not less than that required by the state, to determine whether any condition described <br /> in § 153.003(A) of this chapter exists thereon. The Tree Inspector may investigate all incidents of <br /> infestations by Dutch elm fungus, elm bark beetles, oak wilt fungus, emerald ash borer or any other <br /> non-native invasive pests, epidemic diseases or other factors which are potentially contributory to the <br /> spread of tree disease and pests. <br /> (B) Right of entry. The Tree Inspector may enter upon private premises at any reasonable time for <br /> the purposes of carrying out any of the duties assigned to the Tree Inspector under this subchapter. <br />
