MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION 1160-23 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT FOR <br />MANUFACTURING, COMPOUNDING, PROCESSING, PACKAGING OR TREATMENT OF COSMETICS, <br />PHARMACEUTICALS AND FOOD PRODUCTS AND THE RENDERING OR REFIING OF FATS AND OILS, FOR <br />BIG DIPPER CREAMERY, 2222 MOUNDS VIEW BOULEVARD; <br />PLANNING CASE 2023-005 <br />WHEREAS, the applicant, Julie Guss, Big Dipper Creamery, has applied for a Conditional Use <br />Permit (CUP) for the production of ice cream (primary use), and retail sales (accessory use) at 2222 <br />Mounds View Boulevard, legally described as follows: <br />P I D: 08-30-23-43-0010 <br />Lot 1, Block 1, Herbst Enterprises <br />WHEREAS, the property is zoned B-3 Highway Business, and guided General Commercial in the <br />Comprehensive Plan; and, <br />WHEREAS, Mounds View City Code §160.198(J) permits Conditional Uses in the B-3 district, to <br />include "Manufacturing, compounding, processing, packaging or treatment of cosmetics, <br />pharmaceuticals and food products and the rendering or refining of fats and oils" (Ordinance 1003); and, <br />WHEREAS, Mounds View City Code §160.452(B) includes the criteria for granting conditional use <br />permits (Findings in italics): <br />The use will not create an excessive burden on existing parks, schools, streets and other public <br />facilities and utilities which serve or are proposed to serve the area; <br />FINDING: The use will not create an excessive burden on public facilities. <br />2. The use will be sufficiently compatible or separated by distance or screening from adjacent <br />residentially zoned or used land so that existing homes will not be depreciated in value and <br />there will be no deterrence to development of vacant land; <br />FINDING: The use is not adjacent to residentially zoned land, and is adjacent to <br />office/retail, and industrial uses. There is no anticipated impact to adjacent <br />uses. <br />The structure and site shall have an appearance that will not have an adverse effect upon <br />adjacent residential properties; <br />
