right to require the Developer to install the final wear course at any time prior to <br />that should it deem, in its sole discretion, that such installation will be in the public <br />interest. <br />b. In completing the Improvements, Developer shall comply and cause its agents and <br />employees to comply with all federal, state, and local laws and regulations <br />applicable to the Improvements. <br />Developer shall take all reasonable precautions necessary to protect the public from <br />injury, including but not limited to taking all reasonable precautions to prevent the <br />public from entering the site of the Improvements during construction and erecting <br />signs advising the public of the danger of entering the construction site. <br />d. The Developer shall be responsible for street maintenance for the new public street <br />extension, including street sweeping, until the project is complete and the City has <br />accepted all Public Improvements. The Developer shall be financially responsible <br />for the repair of any damage done to the streets and public utilities from the time of <br />installation until the Public Improvements have been approved and accepted by the <br />City. <br />e. Upon the satisfactory completion of all Public Improvements and inspection thereof <br />by the City and the City's engineer, the City agrees to not only accept said <br />improvements in accordance with the terms of this Agreement, but also agrees to <br />reimburse the Developer $70,800.66 for the public stormwater improvements plus <br />approximately $21,783.04 for the oversizing of public sanitary sewer and water <br />improvements. That latter number ($21,783.04) amounts to 2/14 of the verified <br />estimated cost of the portion of Public Improvements that make up public sanitary <br />sewer and water improvements. It is expressly understood by the Parties that the <br />purpose of such payment is to provide the Developer reimbursement for oversizing <br />of certain improvements that will become public and may be utilized by other <br />properties, including adjacent Ramsey County PIDs 063023140068 and <br />063023140075, that may wish to develop or subdivide and connect to such <br />improvements installed by the Developer in the future, and the City shall retain its <br />statutory authority to impose just and equitable charges to those such landowners <br />in the event they desire to do so. The final number to be reimbursed for the 2/14 of <br />the public sanitary sewer and water improvements shall be reviewed and verified <br />by the City following the Developer's satisfactory completion of all Public <br />Improvements. The Developer agrees to provide the City with any documentation <br />(invoices, contracts, bids, etc.) that may be reasonably necessary for the City to <br />verify such final reimbursement number. <br />f. The Developer understands and acknowledges that as part of the Public <br />Improvements, it will need to remove an existing private driveway encroachment <br />in a portion of existing public right-of-way where the Public Improvements will be <br />installed. Said driveway provides access to a garage located on Ramsey County <br />PID 063023140014, and the Developer agrees that throughout the course of <br />5 <br />MU210-262-628764.v18 <br />
