Proposal <br />If a vacancy occurs in the council or mayor's position, whether by death, disability, change of <br />residency or any other reason, and the vacancy will last longer than 120 days because of <br />election requirements, the remaining council and mayor may choose as a temporary <br />councilmember or mayor the chair of the Mounds New Charter Commission, If this person is <br />unwilling or unable to serve, the remaining council and mayor may choose the chair of the <br />Mounds View Planning Commission. If this person is unwilling or unable to serve, the <br />remaining council and mayor may choose the chair of the Mounds View Economic Development <br />Commission. If that person is unwilling or unable to serve, the remaining council and mayor <br />may choose the Vice Chair of the Mounds View Charter Commission. If that person is unwilling <br />or unable to serve, the position will remain vacant. <br />The person chosen shall have all the responsibilities, obligations and duties of the chosen <br />position. The person chosen shall remain in office until a replacement is elected and sworn in. <br />Questions Rmardint! Proposal <br />The following are high level answers to questions posed about the proposal above. <br />1. Do we need to address the condition of vacancy here, since they already exist in the <br />Charter elsewhere? <br />No, the vacancy language in Section 2.05 already applies and there is no need to list reasons a <br />vacancy exists in a new section. <br />2. Is there any window where an election can be held within 120 days? <br />Potentially, however, it would require the Ramsey County elections office to also sign off on <br />conducting the election and the timing of a regular or special council meeting occurring at the <br />same time. <br />3. Isn't the Council defined already as the council members and mayor elsewhere, so we <br />can drop any reference to "and mayor"? <br />Correct, the "members of the council" are defined in Section 2.03 and include both <br />councilmembers and the mayor. <br />4. Can the word "temporary" be used in the language, once appointed the person isn't <br />"temporary" are they? <br />The appointed individual would be a full council member with a shorter term than typical. I think <br />the term is unnecessary. <br />5. Can the person continue to server on their original appointment while filling the <br />vacancy? <br />
