The Planning Commission makes advisory recommendations to the City Council. The Economic <br />Development Commission makes advisory recommendations to the Economic Development <br />Authority (which consists of the members of the Council). This would result in a member of the <br />council making an advisory recommendation on an item that that member of the council will vote <br />on in the future. <br />Minnesota Statutes allows members of the council to serve on a charter commission unless that <br />city's charter prohibits a person from holding both offices. The Mounds View Charter provides: <br />Section 2.04. Incompatible Offices. No member of the Council shall hold any municipal office or <br />employment through the City other than that to which elected. Further, until one year after the <br />expiration of member's term, no Mayor or Councilmember shall be appointed or employed by the <br />City in a compensated position which was created, or the compensation for which was increased, <br />during member's term as Mayor or Councilmember. <br />"Municipal office" is not defined in the Charter. <br />6. Is a time certain needed to define how soon the appointment can be made, example at <br />the time of the vacancy declaration or as soon as the council orders the election and <br />it is determined to be more than 120 days? <br />No, it is common for a city council to establish its own process for appointing a councilmember to <br />fill a vacancy. <br />7. Is it clear when the appointment would end or does it require more definition? <br />The standard language is that the appointed person will serve "until a successor is elected and <br />qualifies." I would recommend using that same language. <br />8. Is the Council obligated to still hold an election after the appointment since the <br />vacancy is filled with the appointment? <br />It depends on the language that is adopted. Each council seat must be up for election in four-year <br />cycles and the mayor must be up for election every two years. <br />9. Is the Mounds View Economic Commission only filled with Mounds View residents? <br />No, the Economic Development Commission shall include four residents and three business <br />representatives and the business representatives do not need to be residents. <br />10. Since this idea is coming from a sitting council member, regardless of being presented <br />as if from a citizen without Council review, is it a valid proposal or does it need to use <br />the Council proposed change process as outlined in 410.12? <br />If the Charter Commission proposed the amendment it would be considered a Charter Commission <br />instigated proposal not a City Council instigated proposal. The Council initiated process starts <br />when the City Council acts to propose an amendment. <br />
