Was there any issue before the Council in the last year which could not be addressed <br />with Council action, because of only four council members rather than five, example <br />a unanimous vote required and K&G advised that no Council action could be due to <br />only four members? <br />I do not know the answer to this question. Voting thresholds generally fall into two categories in <br />Mounds View because of the language in Section 3.04 stating that "Except as otherwise provided <br />in this Charter, state law or a more restrictive City ordinance, an affirmative vote of three or more <br />members of the Council shall be required for the adoption of all ordinances, resolutions and <br />motions." <br />Thresholds that are more restrictive generally call for a "unanimous vote" or "a four -fifths vote". <br />These type of thresholds require a calculation based on the number of sitting councilmembers. For <br />example, four -fifths of a full five member council is four votes. Four -fifths of a four member <br />council would also be four (since 4/5ths of four is 3.2). <br />12. What additional definitions need to be created around this language for clarity? <br />If the proposal is the direction the Charter Commission wants to go, I would propose redrafting <br />the proposal to follow the direction of the Commission and then could establish whether additional <br />definitions are needed. <br />13. Lastly, can you provide some examples from other charter cities of how their charters <br />handle council vacancy appointments? <br />THREE EXAMPLES FROM OTHER CITIES <br />City of Hopkins, Section 2.05 (2) <br />If the vacancy occurs before the first day to file affidavits of candidacy for the next regular city <br />election and more than two years remain in the unexpired term, a special election shall be held <br />at the next regular city election and the appointed person shall serve until the qualification of a <br />successor elected at a special election to fill the unexpired portion of the term. <br />If the vacancy occurs on or after the first day to file affidavits of candidacy for the regular city <br />election or when less than two years remain in the unexpired term, there need not be a special <br />election to fill the vacancy, and the appointed person shall serve until the qualification of a <br />successor.
