Bid Review - Bids for the Random Park Building Replacement Project were <br />received at 10:00 a.m. on Tuesday, February 2, 2006 at the Mounds View <br />Community Center. <br />A total of six (6) bids were received; a seventh bids was attempted to be <br />submitted after the bidding was closed and was therefore was not accepted. <br />A complete bid summary is as follows: <br />Bidder's Name Alternate A Alternate B <br />Olympic Construction Services, Inc.. $187,795.00 $186,040.00 <br />Jay Bros., Inc. $245,646.00 $244,647.75 <br />Gen -Con Construction $249,624.50 $251,001.25 <br />Ebert Construction $268,154,05 $263,993.27 <br />Cobra Construction, Inc. $270,245.87 $265,116,71 <br />Engineer's Estimate $260,000.00 $255,000.00 <br />A summary of the bids including a bid tabulation was submitted by BRAA. See <br />attachment. <br />Review of Low Bidders Bid Bond and References <br />As a standard course of action, the City's consult starting to review references of <br />the apparent low bidder. During this process it was discovered there maybe <br />issues with references and / or bonding irregularities of the apparent low bidder. <br />Due to these issues the City's consultant recommended that the City review the <br />bid bond that was submitted. Staff has contact the surety company that issued <br />the bid bond of the apparent low bidder on Wednesday, February 8, 2006. The <br />surety company indicated to Staff that the bond submitted to the City may not be <br />in order and would fax a letter summarizing their position on this matter on <br />Thursday, February 9, 2006. This fax was received at 1;47 p.m. on Thursday. It <br />is attached for Council's review. The City's legal counsel has been contacted, <br />briefed on this matter, and will be providing consultation on how the City should <br />proceed. <br />The remainder of this report and resolution will be written with the <br />assumption the city's legal counsel has determined that the bid bond <br />submitted by Olympic Construction does not meet the requirements as set <br />forth in the bidding specifications and therefore their bid is deemed non- <br />responsive, and should therefore be rejected on this basis. <br />
