www.publichealthlawcenter.org 12Lower-Potency Hemp Edibles & Cannabis: Minnesota City Retailers <br />Municipal Cannabis Retailer <br />Similar to municipal liquor stores, state law allows for local governments to operate municipal <br />cannabis retailer businesses. (Minn. Stat. § 342.32, subd. 5) Operating their own retailer would <br />allow local jurisdictions to better control store location, types of products available, advertising, <br />and marketing while making products available. Any municipal cannabis retailers do not count <br />toward the total number of retailer licenses offered by OCM during a licensing period and the <br />municipal retail license does not count toward any local ordinance capping the number of <br />retailers to no more than 1 per 12,500 residents. (Minnesota Session Laws, 2024 Regular Session, <br />Ch. 121 Art. 2 Sec. 65 creates new Minn. Stat. § 342.32, subd. 7) <br />Section 4. Registration and Operations of Registered Retailers. <br />(A) License required. No person shall sell or offer to sell any approved product or medical <br />cannabinoid product without first having obtained a license or retail endorsement to do so <br />from the Office of Cannabis Management. <br />(B) Registration required. No person shall sell or offer to sell any approved product or <br />medical cannabinoid product without first being granted a registration by the city. <br />Operating a retail establishment without a valid retail registration is a violation of this <br />Ordinance and of Minn. Stat. § 342.22, subd. 5(e) and is subject to a civil penalty of up to <br />$2,000 per violation. <br />Registration <br />State law mandates that cannabis businesses and hemp businesses with retail sales, including <br />lower-potency hemp edible retailers and retail businesses selling medical cannabis, must register <br />with the city, town, or county in which the retail establishment is located. A county may issue <br />a registration in cases where a city or town has provided consent for the county to issue the <br />registration for the jurisdiction. A second registration from the county is not required if a city or <br />town provides the registration. <br />September 2024
