While this does not affect the pond, it is a hazard to pedestrians :tear the pond. 4.3 Permitting Requirements As discussed in Section 3.2, the Minnesota Wetland Conservation Act (WCA) requires replacement for excavation in Type 3, 4, or 5 wetlands, but provides an exemption for maintenance of previously constructed wetland stormwater treatment ponds. If sediment is to be removed but to no greater extent than recreating the basin's originally constructed configuration, LGU coordination and a WCA permit will be required. If more extensive excavation to expand the basin beyond its original configuration is performed, then wetland replacement will be required.
