5.0 WATER RESOURCES RELATED AGREEMENTS <br />5.1 MEMORANDUM OF UNDERSTANDING WITH THE RCWD <br />The City will enter into a Memorandum of Understanding (MOU) with RCWD within 180 days of the <br />RCWD's approval of the City's LSWMP for RCWD to cease applying its Rules C, D, E, and F in the City and <br />for the City to adopt these rules by reference (see Appendix Q. The City will also work with BWSR on <br />resolutions for the City to accept the authority and responsibility to implement WCA in the City. <br />5.2 SPRING CREEK REGIONAL POND AGREEMENT WITH THE RCWD <br />Mounds View made an agreement with the RCWD to address the outstanding RCWD runoff treatment <br />requirements for the City's 2003 Street and Utility Improvement Project, which was permitted by RCWD <br />under Permit 04-061. In 2003, the City proposed to fulfill these outstanding requirements by the <br />construction of the Spring Creek Regional Pond. However, with further investigation into the feasibility of <br />constructing the Spring Creek Regional Pond, the City found that construction of the pond was no longer <br />the preferred approach to address the outstanding RCWD stormwater management requirements for <br />Permit 04-061. <br />This agreement officially recognized that the City will not be constructing the Spring Creek Regional Pond <br />to fulfill the outstanding RCWD stormwater management requirements for Permit 04-061. Rather, these <br />outstanding requirements have been addressed through the construction of infiltration features designed <br />in accordance the City's Stormwater Infiltration Program (SIP) and included in the Street and Utility <br />Improvement Program (SUIP) projects. The agreement states that the treatment volume necessary to <br />fulfill the outstanding requirements of Permit 04-061 will be distributed amongst the nine SUIP projects, <br />with the distribution being proportional to each project's percentage of the total SUIP size. The SIP and <br />SUIP have been completed, and the City worked with the RCWD to close all open permits that address <br />the City's treatment volume requirements.
