6.0 CURRENT ASSESSMENT <br />The following section is an assessment of the City's current surface water system. The assessment <br />includes surface water system issues identified by the City, found in the RCWD watershed management <br />plan, or as discussed in a specific LSWMP reference identified in Section 4. <br />Based on the assessment presented in this section, the City will develop effective surface water <br />management goals and policies (Section 7) and, with the coordination of the RCWD, establish the <br />implementation measures (Section 8) necessary to enact the goals and policies and address the surface <br />water management issues. <br />As noted in Section 3.1, it is the City's intent to adopt by reference and enforce RCWD's Rules C, D, E, <br />and F and for the City to accept the authority and responsibility to implement the Wetland Conservation <br />Act (WCA) in the City. <br />6.1 OFFICIAL CONTROL ASSESSMENT <br />Codes and ordinances (official controls) are necessary tools to support the implementation of this <br />LSWMP. The intent of assessing the City's existing official controls is to identify the adequacy of these <br />controls. As a basis for this assessment, the City's MS4 permit documents include a summary of <br />ordinances required to meet NPDES requirements. The City Code can be found here: <br />http://www.moundsviewmn.org/government/codes regulations and fees/city code.php <br />It is the City's intent to adopt by reference and enforce RCWD Rules C — Stormwater Management, D — <br />Erosion and Sediment Control, E — Floodplain Management, and F — Wetland Alteration. The <br />corresponding ordinances in the City Code will be updated to reflect this change (see Appendix D). The <br />RCWD will no longer apply its authority for Rules C, D, E, and F within the City but will continue <br />administering the remaining RCWD rules in the City, which will require permits with RCWD. Additional <br />steps for the City to adopt RCWD rules C, D, E, and F by reference are listed below: <br />• Provide draft ordinances that adopt RCWD Rules C, D, E, and F by reference for RCWD review <br />and approval and revise City Code within 180 days of RCWD approval of the LSWMP. <br />• Implement inspection and administrative procedures necessary to ensure the full regulatory <br />standards of RCWD are met, including procedures for permit application review, inspections and <br />enforcement, permit closeout, hydraulics/hydrology data, and the RCWD audit. <br />• Adopt resolutions to satisfy BWSR's requirements for accepting WCA authority per MN Rule <br />8420.0200. <br />• Enter into a MOU with the RCWD for the City to adopt ordinances that adopt RCWD's Rules C, D, <br />E, and F by reference within 180 days of RCWD approval of the LSWMP and for RCWD to no <br />longer assert its authority for those rules. RCWD will continue to require permits in the City for its <br />remaining rules. <br />• The City understands that if these actions are not completed within 180 days of RCWD's approval <br />of the LSWMP, RCWD will continue asserting its authority for RCWD Rules C, D, E, and F and <br />serving as the WCA LGU in the City. <br />City of Mounds View 27 <br />Local Surface Water Management Plan Stantec Project No. 193804166 <br />5 5tantec <br />
