Item 08D <br />Page 3 of 11 <br />Lot 3 consists of 14 parking stalls which will be sold by AP <br />Mounds View to Infinity Properties (Moe's Restaurant). During the <br />July 711 Planning Commission meeting, Moe's expressed interest <br />in expanding outdoor seating. If any permanent structures are <br />built on Lot 3, it will likely require an amendment to the PUD <br />Narrative to change the allowable uses, or to remove Lot 3 from <br />the O'Neil Property PUD Narrative. <br />The 1997 PUD Narrative required the Theater to have 662 parking <br />stalls (proof of parking for 700 stalls). Only 487 parking stalls <br />exist, and will be reduced to 439 stalls (loss of 48 stalls). It is not <br />known why the PUD Narrative is more restrictive than the City <br />Code, unless the theater was built smaller than what was planned <br />in 1997. <br />It is Staff's opinion that the theater has sufficient parking, and is <br />unlikely to have every seat occupied at the same time, requiring <br />parking for 662 vehicles. <br />During the July 71" Planning Commission meeting, the <br />Commission discussed what -if the Theater becomes a different <br />use, such as a church? The PUD Narrative would need to be <br />amended, and the needs would be re -addressed at that time. <br />Tree Preservations All trees within the project area will be removed, including a line of <br />mostly ash trees along the trail. Such trees will be replaced by the <br />Stormwater infiltration basin. The tree removal is consistent with <br />the City's tree protection requirements; to attempt to preserve the <br />maximum number of significant and specimen trees (Ash is <br />neither a significant, nor a specimen tree). <br />All trees to be removed within the project area, between the trail and the storm water <br />infiltration basin (photo, April 23, 2021). <br />The Developer is requesting to thin -out and remove trees within <br />the right-of-way, on the southeast corner of Mounds View <br />Boulevard & Edgewood Drive, to improve motorists' view of <br />Caribou.
