Mounds View City Council November 26, 1990 <br />Regular Meeting Page Two <br />-------------------------------------------------------------------------- <br />• There were no questions, so Mayor Hankner closed the <br />public hearing and reopened the regular meeting at <br />7:11 PM. <br />Motion/Second: Paone/Blanchard to approve Resolu- <br />tion No. 4013, approving the wetland alteration <br />permit for William Melon to construct a fence within <br />a wetland zone, at 6953 Pleasant View Drive, Planning <br />Case No. 317-90, and waive the reading. <br />4 ayes 0 nays <br />Councilmember Wuori questioned whether the City <br />could be liable in the event of flooding, with the <br />fence coming down. <br />Attorney Karney advised there would be no liability <br />for the City, that it would be the responsibility <br />of the property owner and most likely his homeowners <br />insurance. <br />Councilmember Blanchard requested Item E be removed <br />from the consent agenda. <br />• Motion/Second: Paone/Wuori to approve the consent <br />agenda, minus Item E, and waive the reading of the <br />resolutions. <br />4 ayes 0 nays <br />Councilmember Blanchard stated she did not feel a <br />non-intoxicating liquor license was allowable for <br />Phillips 66, as the Municipal Code prohibits the <br />sale of liquor within 500 feet of a school or <br />church. <br />Mr. Minetor reported Staff had researched that and <br />agrees the property line of the church extends all <br />the way down toward the station, thus disallowing <br />the license for Phillips 66. <br />Motion/Second: Blanchard/Paone to approve Item E, <br />licenses for approval, minus the non-intoxicating <br />liquor license for Phillips 66. <br />4 ayes 0 nays <br />Mr. Minetor reviewed the proposed addendum to the point <br />powers agreement of Northwest Youth and Family Services. <br />Motion/Second: Wuori/Paone to approve the addendum to <br />the joint powers agreement. <br />Motion Carried <br />6.
