Blanchard stated that <br />$30 is more consistent with the City's other fees. <br />Councilmember Quick stated even with the current fees the <br />door to door sales people and peddlers aren't coming in to <br />get licensed. <br />Councilmember Wuori stated that she concurrs with Councilmember <br />Blanchard in that the fines should be raised rather than the <br />licensing fees. <br />Samantha Orduno, City Administrator, stated that selling without <br />a license in the City is a $500 fine and considered a misdemeanor which <br />could involve serving time for a period not to exceed 90 days. This <br />does not bring money into the City's coffers. There is the possibility <br />that the ticket may be overturned or reduced. <br />Vote on Resolution 4208 as amended. <br />VOTE: 5 ayes 0 nays Motion Carried <br />2) Mayor Linke opened the public hearing to consider the request for <br />a Conditional Use Permit for the property located at 8315 <br />Pleasantview Drive at 7:22 p.m. Paul Harrington, City Planner, <br />reviewed Staff Report 92-203C regarding the applicant's proposal <br />and stated that the request meets all applicable require- <br />ments set forth in Chapter 40 of the Code including height, area <br />and setbacks. <br />Rosemary Lensing, 8310 Pleasantview Drive, stated this is too <br />oversized. Residents have to realize they live in a county not <br />township. <br />Merl Lensing, 8310 Pleasantview Drive, stated that he has seen these <br />oversized garages constructed before and the owner uses them to fix <br />cars. How does the City enforce the Code if this turns into a car <br />fixing place? This resident stated he did not want to go against any <br />one person but he is a builder and has heard of people creating walls <br />in their building so it is in compliance with the Code and after <br />the decision is granted for their building they rip out the wall. <br />Mayor Linke stated that the Code is specific and the City can <br />enforce it if those types of violations are found. <br />Harrington stated that the Code does allow home occupations <br />if the person meets certain criteria. Only persons who live <br />in the residence can work there, the business can't generate on street <br />• parking, as well as noise and odor free. Violations of the Cade can be <br />enforced if the City is made aware of those violations. <br />
