Staff has <br />identified several parts of Title 1000 that the City should change and update. <br />Background: <br />On January 10, 2011, the City Council approved the introduction and first reading of <br />Ordinance 853. This is an ordinance that makes changes to Title 1000 (Building and <br />Development regulations) of the City Code. <br />Discussion: <br />Since the Council work session on December 6, 2010, City staff has investigated further <br />when a property owner must use a licensed contractor to do work or to make <br />improvements to their property. To summarize, if a contractor is doing work that requires <br />a building permit, they must have either a State license or a City license. For a City <br />license, staff ensures that the contractor has liability and worker's compensation <br />insurance. <br />State residential contractor licenses apply to contractors working on buildings with up to <br />four units. These licensed contractors must prove competency and complete continuing <br />education in order to maintain their State license. The Department of Labor and Industry <br />DOLI) does the licensing of contractors for the State. Chapter 326B of Minnesota State <br />Statutes defines residential buildings with one to four units as residential real estate and <br />those with more than four units as a commercial property. The State considers <br />contractors working on dwellings with more than four units as commercial contractors and <br />no State contractor license is required. The City of Mounds View licenses these <br />commercial contractors (MV Code Section 1006.04). As part of this requirement, the City <br />requires the contractors to provide proof of general liability insurance as outlined in City <br />Code 1006.04 Subd. 6. Sufficient insurance is critical in the case of an accident or any <br />unforeseen expense from doing substandard work.
