Ordinance 853 Staff Report <br />January 24, 2011 <br />Page 2 <br />As we noted in December, staff did a thorough review of all of Title 1000 of the City Code. <br />This review by staff revealed several parts of Title 1000 that the City needs to change and <br />update. The Code changes are necessary because changes in State regulations, <br />changes in City practices and policies and a need to help clarify various parts of the Code. <br />More specifically, the City should update the Code references to State statutes (especially <br />those related to the electrical and plumbing codes), clarify the practices and penalty <br />sections, and clarify what projects need building permits and what projects need zoning <br />permits from the City. Staff also is proposing changes to the Code language about <br />contractor licensing including the removal of the language that requires City Council <br />approval of contractor licenses. Since the City Council does not investigate the <br />contractors or have any detailed information about them, it is unnecessary for the City <br />Council to approve contractor licenses. This is an administrative task that City staff can <br />and should perform. <br />At the direction the Council on January 10, staff changed Section 1006.02, Subd. 4 of the <br />ordinance (on page 10) about the City refunding (or not refunding) permit and plan check <br />fees. <br />Recommendation: <br />Staff recommends that the City Council approve the second reading and adoption of <br />Ordinance 853.
