To Approve the Consent Agenda as Presented. <br />Council Member Stigney asked Ms. Reed to explain the change made to the Police Civil Service <br />Commission position description. <br />Assistant City Administrator Reed indicated she had taken the information from state statute and <br />included that Council makes the final appointment as was discussed by Council. <br />Ayes - 5 Nays - 0 Motion carried. <br />7. COUNCIL BUSINESS <br />A. Public Hearing to Consider Removal of Jakes' Parcel from Theater Planned <br />Unit Development Agreement. <br />Mayor Sonterre opened the public hearing at 7:45 p.m. <br />Community Development Director Ericson explained that the request before Council is to <br />remove the parcel from the theater Planned Unit Development Agreement. He then indicated <br />that Jakes had entered into a Purchase Agreement with the property owners to allow Jakes to <br />expand parking onto the parcel. He further indicated the City would be entering into a new <br />development agreement with Jakes to control the landscaping and other issues surrounding the <br />development of the parcel. <br />Director Ericson indicated that the theater was approved in 1998 with two retail restaurant pads <br />and two office pads. The parcel in question is in between the Mounds View School District <br />building and Jakes. <br />Director Ericson indicated that Jakes has been in business for almost year and business is great <br />but they are under parked and customers frequently overflow into the theater parking lot on <br />weekends. He also explained that, with the H2 reconstruction, Jakes is looking at losing 13 stalls <br />and needs to expand parking to remain a viable business. <br />Director Ericson indicated the issues involved with removing the parcel from the PUD are <br />straightforward and the City has done this before for Realife and the Minnesota Institute of <br />Public Health. He then explained the process is to hold a public hearing for resident comment. <br />Director Ericson indicated that, if the parcel is pulled from the PUD, the Jacobs are concerned <br />with the setback to H2 and what can be put in for a parking lot. He then indicated that currently, <br />under the conditions of the PUD, there is a 50-foot setback. But, if this lot were pulled from the <br />PUD, that would fall back to a 30-foot setback. <br />• <br />
