Director Ericson indicated this matter was before the Planning Commission and the Commission <br />unanimously recommended that the parcel be pulled from the PUD and attached to the Jakes <br />parcel to allow for the creation of a new development agreement. <br />Director Ericson indicated he had put together a resolution that would accomplish removing the <br />parcel from the PUD and it is Resolution 5803. He then read the stipulations of approval for <br />Council. <br />Council Member Stigney asked for clarification of the site plan. <br />Director Ericson indicated the proposed site plan that was submitted for the Jakes' parking <br />expansion shows a 30-foot setback. <br />Council Member Stigney commented he had seen three layouts and asked which is the final plan. <br />Director Ericson indicated the one before Council this evening is the final plan and the others <br />were concept plans. <br />Council Member Stigney commented that the 50-foot buffer was to screen residents from the <br />theatre and then asked if 20 feet of trees would be cut down. <br />Director Ericson said that is correct. <br />Council Member Stigney indicated he had no problem with pulling the parcel out of the PUD but <br />said Jakes would need to maintain the buffer. <br />Council Member Marty asked how many trees would be lost. <br />Director Ericson indicated he had been out at the site with the City Forester and he estimates that <br />there maybe approximately 10 significant trees that would come down along with some more <br />scrub trees and less significant trees. He also commented that the City Forester recommends <br />removing some of the trees for the health of the other trees. <br />Council Member Marty asked if there would be a fence along there. <br />Director Ericson indicated the proposal would have a fence to maintain screening. <br />Council Member Marty asked if the parking could be laid out east to west rather than north to <br />south to maintain the buffer. <br />Director Ericson indicated that was a great idea but the property would need to be replatted and <br />the property owner is not in favor of redrawing the lot lines as that would involve park dedication <br />fees. <br />• <br />
