Mounds View City Council September 22, 2003 <br />Regular Meeting Page 16 <br />• 1 5. Update on Community Center <br />2 <br />3 City Administrator Ulrich indicated that Staff has been in negotiations with the existing caterer <br />4 over the budget but has not yet received the insurance notice, performance bond or the required <br />5 marketing plan. He then indicated that the City Attorney has recommended that the City allow <br />6 the fu1130 day cure period to expire and send out a letter notifying the contractor that they are not <br />7 in compliance with the terms of the contract. <br />9 City Administrator Ulrich indicated there was a proposal from a competing vendor so there is <br />10 potential that the City could reach a negotiated agreement on the contract prior to the 30 days or <br />11 with a new vendor. <br />12 <br />13 Mayor Linke indicated he felt it would be premature to enter into negotiations in case the <br />14 contractor performs. <br />15 <br />16 City Administrator Ulrich indicated the City Attorney has said that there could be negotiations <br />17 with both the existing and new vendors but the City needs to allow the proper cure time. <br />18 <br />19 City Attorney Riggs indicated the City would not be acting on any proposal but negotiating with <br />20 the present contractor to let them know if they are not going to comply the City is going to find <br />21 another vendor. <br />2 <br />23 City Administrator Ulrich asked for authority to try and negotiate with the existing contractor to <br />24 bring back options for consideration short of termination. <br />25 <br />26 There was consensus of Council to proceed with negotiations. <br />27 <br />28 City Administrator Ulrich indicated he had provided an Administrator's Digest and highlighted <br />29 that there would be thinning of trees at Groveland Park and noted that approximately 30 black <br />30 locust trees would be removed from the area next to the playground because they are rotted and <br />31 pose a safety hazard. The trees removed will be replaced with other plantings. <br />32 <br />33 Community Development Director Ericson indicated he had attended the Ramsey County Board <br />34 of Commissioners meeting and Ramsey County conveyed to the City tax forfeited parcels that <br />35 were a part of the golf course that the City did not hold title to. <br />36 <br />37 Director Ericson indicated that on the same day the HRA met and voted to adopt the maximum <br />38 levy for the HRA but that does not mean they will go forward or levy the maximum but they did <br />39 put in the process the ability to go forward. <br />40 <br />41 Council Member Marty commented that he feels it is a good idea that access and authorization <br />42 has to be approved by the City Administrator and the Cable Coordinator. He then said he would <br />43 like Staff to determine what the proper battery charging procedure is for the type of batteries in <br />+14 the camcorder in order not to compromise battery life. <br />45 <br />
