Mounds View City Council May 9, 2005 <br />Regular Meeting Page 14 <br />• Contamination Study. <br />Council Member Thomas acknowledged the competitive advantages noting that the new location <br />would level the playing field and provide them with similar advantages to the corridor. <br />Council Member Stigney referenced the dimensional requirements and setbacks and questioned <br />how all the answers could be yes if this hasn't met all of the requirements. He stated that he is in <br />favor of onsite water retention versus ponding and asked who would pay for the estimate and <br />costs. <br />Director Ericson agreed stating that this should have been corrected. He stated that this is also <br />Staff's position. He stated that the possibility to acquire land at a fair market value was one of <br />the items conveyed to and discussed with the applicant. <br />Mr. Leonard assured the Council that he would be a good neighbor and would maintain the <br />landscaping based on the requirements. <br />Council Member Stigney referenced the zero setbacks and asked for further clarification. <br />Mayor Marty stated that the Public Works Director has indicated that they have conveyed the <br />landscaping requirements for the east side to the applicant noting that he is in support of the <br />acquisition of the 15-foot strip to Snyder's. <br />Director Ericson acknowled ed that Staff su orts this but it is not art of the resolution. He <br />g pP p <br />explained that the City couldn't legally require an applicant to purchase City land. He stated that <br />it is his belief that adequate protection could be built into the agreement that states that the <br />applicant would be responsible for maintaining the landscaping. <br />Mayor Marty recalled that Staff did come to Council to discuss the stormwater ponds on City <br />property. He stated that it was his recollection that when this issue was discussed it was under <br />the context that the City would purchase the property. He stated that he would prefer to see the <br />applicant control the water drainage on the property noting that there might be a need to re-do the <br />design to accommodate a pond. He suggested that the applicant consider ways of controlling the <br />water drainage on their own. <br />Mr. Leonard clarified that Director Ericson was the one who brought up the idea of placing the <br />drainage pond in this area. <br />Director Ericson stated that the terminology should be clarified. He explained that the City was <br />interested in the possibilities of what could happen on the site and confirmed that it was Staff's <br />idea for the ponding. He stated that it was also conveyed to the applicant that this idea would <br />require City Council approval. <br />• Mayor Marty stated that when this was discussed with Public Works Director Lee he asked if he <br />had any problems with the public runoff and it was stated that constructing a stormwater pond <br />
