He stated that a draft <br />development agreement could be written in such a way that adequate protections are put in place. <br />Mayor Marty asked Director Ericson how soon he would be able to meet with the Rice Creek <br />Watershed and Staff. <br />Director Ericson stated that he could meet with both prior to the next meeting. He stated that he <br />would schedule the meetings and provide Council with an update at the May 23, 2005 Council <br />meeting. <br />Mayor Marty stated that he does understand the need to create their own identity adding that he <br />would like to see the colors toned down a bit, as it is the main business corridor in Mounds View. <br />He stated that as far as the zero lot line, it was nice and thoughtful gesture noting that it would <br />create a nice buffer. He stated that if approved the applicant would have to maintain this area. <br />Mr. Leonard assured Council that they would maintain the property, including the mowing. <br />Council Member Flaherty stated that he likes the color scheme and has nothing against them <br />wanting to give the City trees. He stated that he wants to hear what Rice Creek Watershed has to <br />say noting that his preference would be to do something onsite to manage the stormwater <br />drainage. <br />• Mr. Leonard stated that if this project is not approved that Snyder's would be leaving the area. <br />He assured Council that there was no question on the possibilities of leaving, as he is losing <br />money in the current location. He stated that it is his belief that the proposed location would give <br />them a fair edge to compete. <br />MOTION/SECOND Stigney/Marty To Authorize postponing action on Resolution 6524 until <br />issues have been addressed with the Rice Creek Watershed and the developer can clarify the lot <br />line, landscaping and color scheme. <br />Ayes - 1 Nays - 4 (Marty, Thomas, Flaherty, Gunn) Motion failed. <br />MOTION/SECOND. Gunn/Thomas To Approve Resolution 6524 and to Approve the <br />Development Review for a Retail Development at 2525 County Road 10. <br />Ayes - 4 Nays -1 (Stigney) Motion carried. <br />D. Resolution 6513 Consideration of a Minor Subdivision at 8060 Groveland <br />Road. <br />Ms. Prososki stated that the applicant, Integra Homes, has applied for a minor subdivision of the <br />property located at 8060 Groveland Road. She stated that the applicant is proposing to divide the <br />back 271 feet from the existing lot. She stated that the existing house does meet with the setback <br />requirements and the lot would be well inside the excess of the minimum requirements. She <br />
