Mounds View City Council September 12, 2005 <br />Regular Meeting Page 6 <br />the concern expressed about the runoff and trees. <br />Councilmember Thomas stated she thinks it is not necessary to table since it can be included as a <br />condition of approval. She noted that the runoff issues and the item on the agenda are not <br />related. There is no change in the surface area and it is Staff's responsibility to check the grading <br />and runoff issues. <br />Mayor Marty stated he can see both sides of the issue but believes that if this item is tabled, the <br />City still has some control over the situation. <br />Councilmember Thomas suggested those conditions be added to the resolution. <br />MOTION/SECOND: Stigney/Gunn. To waive the reading and adopt Resolution 6613 <br />Approving a Conditional Use Permit (CUP) fora 1,082 square-foot Garage at 7069 Pleasant <br />View Drive; Planning Case No. CU2005-006; as amended to add Condition #2, Staff to address <br />runoff problem satisfactorily. <br />Director Ericson explained that it is not necessary to add a stipulation regarding trees since it <br />does not relate to the Conditional Use Permit for the garage. He stated that Mr. Hansen is now <br />aware that trees cannot be cut from the wetland district. <br />Mayor Marty stated that cutting a purportedly dead tree from the neighbor's property is a concern <br />• to him. Director Ericson agreed and stated Staff certainly does not encourage a resident from cut <br />down another resident's tree. <br />Councilmember Flaherty asked for an explanation of the amendment. <br />Councilmember Stigney stated it would require the concerned neighbor to be satisfied and assure <br />it does not fall through the cracks, which would not happen anyway. <br />Councilmember Flaherty stated the water runoff is his concern and he agrees with the motion on <br />the floor. <br />Director Ericson stated Staff will visit the site tomorrow. <br />Ayes-5 Nays-0 Motion carried. <br />B. Continued Public Hearing from August 22, 2005 for Resolution 6600 A <br />Transfer of Ownership of an On-Sale Intoxicating Liquor License for Jake's <br />Sports Cafe located at 2400 Highway 10. Transfer of Ownership is from <br />Mounds View Jake's Inc., to Thomas Stuart <br />Administrative Assistant Crane advised that this Public Hearing needs to be continued to the <br />• September 26, 2005, City Council meeting because the closing of sale on the property has been <br />postponed yet again. An opportunity for public comment was made at the August 22, 2005, City <br />
