Mounds View City Council Apri113, 2009 <br />Regular Meeting Page 2 <br />• <br />MOTION/SECOND: Gumi/Mueller. To Recess the Council Meeting and Reconvene the EDA <br />Meeting at 7:23 p.m. to complete the EDA agenda. <br />Ayes - 5 Nays - 0 Motion carried. <br />Mayor Flaherty reconvened the Council Meeting at 8:03 p.m. <br />7. COUNCIL BUSINESS <br />A. 7:05 p.m. Public Hearing, First Reading of Ordinance 819, an Ordinance to <br />Approve an Amendment to Chapter 7, Section 7.03 of the City Charter <br />Relating to Taxation and Finances. <br />Clerk-Administrator Ericson presented the Charter Commission's recommendation for <br />amendments to revise Charter language related to fees. If the Council approves First Reading <br />tonight, Second Reading would be considered on April 27, 2009. <br />Mayor Flaherty opened the public hearing at 8:07 p.m. <br />Hearing no public input, Mayor Flaherty closed the public hearing at 8:07 p.m. <br />• MOTION/SECOND: Mueller/Hull. To Waive the Reading, Approve the First Reading, and <br />Introduce Ordinance 819, Amending Chapter 7, Section 7.03, of the City Charter Relating to <br />Fees subject to Provisions of Section 7.03, Subdivisions 1 and 2. <br />Council Member Stigney questioned the ordinance wording for annual re-certification and if the <br />increase is the total of all fees, or each individual fee. Clerk-Administrator Ericson stated the <br />intent of the language that applicable fee may increase by more than 5% or the CPI plus 2%, <br />whichever is less. The Xcel and Centerpoint Energy franchise limit the franchise fee to a <br />maximum 4% and once the franchise expires in 2012, it can be looked at again. Council <br />Member Stigney stated the Charter language should identify and resolve that question now, not <br />in 2012. <br />Mayor Flaherty stated this language is being recommended because it is not known what will <br />happen in 2012. Clerk-Administrator Ericson stated there are two components. He explained <br />that the franchise fees sunset each year by Council order so prior to this proposed amendment, a <br />referendum vote of the residents would have been required each year, which was not the intent of <br />the Charter Commission. <br />City Attorney Riggs stated the explanation of Clerk-Administrator Ericson is correct. <br />Council Member Stigney stated the language addresses half of the question but leaves the other <br />• half open. <br />
