Ayes - 5 Nays - 0 Motion carried. Mayor Flaherty reconvened the Council Meeting at 8:03 p.m. 7. COUNCIL BUSINESS A. 7:05 p.m. Public Hearing, First Reading of Ordinance 819, an Ordinance to Approve an Amendment to Chapter 7, Section 7.03 of the City Charter Relating to Taxation and Finances. Clerk-Administrator Ericson presented the Charter Commission's recommendation for amendments to revise Charter language related to fees. If the Council approves First Reading tonight, Second Reading would be considered on April 27, 2009. Mayor Flaherty opened the public hearing at 8:07 p.m. Hearing no public input, Mayor Flaherty closed the public hearing at 8:07 p.m. • MOTION/SECOND: Mueller/Hull. To Waive the Reading, Approve the First Reading, and Introduce Ordinance 819, Amending Chapter 7, Section 7.03, of the City Charter Relating to Fees subject to Provisions of Section 7.03, Subdivisions 1 and 2. Council Member Stigney questioned the ordinance wording for annual re-certification and if the increase is the total of all fees, or each individual fee. Clerk-Administrator Ericson stated the intent of the language that applicable fee may increase by more than 5% or the CPI plus 2%, whichever is less. The Xcel and Centerpoint Energy franchise limit the franchise fee to a maximum 4% and once the franchise expires in 2012, it can be looked at again. Council Member Stigney stated the Charter language should identify and resolve that question now, not in 2012. Mayor Flaherty stated this language is being recommended because it is not known what will happen in 2012. Clerk-Administrator Ericson stated there are two components. He explained that the franchise fees sunset each year by Council order so prior to this proposed amendment, a referendum vote of the residents would have been required each year, which was not the intent of the Charter Commission. City Attorney Riggs stated the explanation of Clerk-Administrator Ericson is correct. Council Member Stigney stated the language addresses half of the question but leaves the other • half open.
