Mounds View City Council Apri127, 2009 <br />Regular Meeting Page 2 <br />• Mayor Flaherty read in full a Proclamation declaring May 7, 2009, as Arbor Day. <br />Council Member Mueller commented that trees are vital to humanity and she is proud of Mounds <br />View for being a Tree City. <br />7. COUNCIL BUSINESS <br />A. 7:05 p.m. Public Hearing and Consideration of Resolution 7444 Regarding a <br />Conditional Use Permit Application for Robert's Sports Bar Located at 2400 <br />County Road H2. <br />Community Development Director Roberts presented the application of Robert's Sports Bar for a <br />Conditional Use Permit (CUP) to hold flea markets, farmer's markets, and auctions at its facility <br />from April 2 to September 30 of each year. The intended use is on Thursdays, Saturday and <br />Sundays from 7:30 a.m. to 1:30 p.m. and auctions two times each month that would be conducted <br />by GSC Auction Services. Community Development Director Roberts described the availability <br />of parking and Mr. Halverson's proposal to rent 80 parking spots to vendors. It was noted the <br />intended use is during morning hours before the sports bar is busy. <br />Community Development Director Roberts presented Zoning Code criteria to be considered on the <br />relationship of the requested use with the Comprehensive Plan, location and character of the <br />surrounding area, potential for depreciation, and demonstrated need for such a use. He stated this <br />has been a challenging request and while the City supports local businesses it also has to assure <br />that new uses meet all Code requirements and are not disruptive to neighboring properties. He <br />advised of the a-mail received from the operator of Moe's Restaurant expressing concern about <br />parking and overflow traffic. An agreement is in place with the owners of the Taiko Sushi Bar to <br />the east for overflow parking so it is not thought that parking will be an issue. <br />Mayor Flaherty opened the public hearing at 7:26 p.m. <br />Kevin Halverson, applicant and owner of Robert's Sports Bar, asked that staff call him should any <br />problems come up and to allow a grace period to resolve issues. He stated he hopes the proposed <br />use will bring business to Moe's Restaurant, which is opened for breakfast, and if parking is a <br />problem, he could consider another parking location and busing patrons to his site. <br />Hearing no additional public input, Mayor Flaherty closed the public hearing at 7:29 p.m. <br />Council Member Mueller stated the previous owner of Robert's held Saturday morning auctions at <br />that location. Mr. Halverson explained that auction has five owners and when Robert's closed, it <br />was moved to the Eagle's Club on Highway 65. Mr. Halverson stated his intention is to hold the <br />auction outside, but without the use of a microphone or speaker system. <br />Council Member Mueller stated it appears Mr. Halverson is working with a reputable auctioneer. <br />Mr. Halverson stated that is correct and the auctioneer is licensed, insured, and has a wide <br />following of customers. He stated his hope this will provide a different service than available in <br />Mounds View to bring in people and more patrons for Mounds View's businesses. <br />
