Mr. Ericson explained that the building is located in between Mounds <br />View Community Center and Walgreens. <br />Director Ericson explained that there is a provision in the resolution of approval that requires the <br />Beltings to execute a cross access, joint parking and maintenance agreement with the adjoining <br />Walgreens site. Director Ericson stated that Walgreens is not willing to consent to such an <br />agreement at this time. He also stated that the local management of the Walgreens store said that <br />overflow parking is not a big deal; however, this has not been obtained by writing. <br />Director Ericson noted that the Belting building is seven stalls short on parking. Based on the <br />square footage of the building and parking requirements, the building requires 50 parking stalls <br />and there are currently 43 stalls. He is asking the Council for consideration as to where the seven <br />additional stalls can be located. <br />Director Ericson stated that the Council considers three options relating to the parking dilemma. <br />He explained that the first option is to allow parking in seven stalls in the Community Center <br />parking lot. Director Erickson explained that there is adequate parking at the Community Center, <br />but he is not sure the Community Center wants to start to obligate or parcel off parking spots. He <br />stated that the Beltings have indicated they will likely never need the stalls, and if they do, they <br />would park as far away from the Community Center as possible. <br />Director Ericson explained that the second option is to waive the requirement to provide the <br />• additional seven stalls. He stated that this it not typically done and it opens the door for <br />precedent for other entities to ask for the same type of consideration in the future. <br />Director Erickson stated that the third option is for the applicants to apply for a variance process <br />with the Planning Commission. He stated there may be some hardship in this option as the <br />development was approved with the vision of joint parking and recognition that there would be <br />some overflow parking for either site. <br />Director Ericson stated that the Beltings are asking for relief and it is his personal opinion that <br />the building will never need the seven stalls. He stated that he hesitates for the City Council to <br />waive the requirement for the seven stalls. He stated the PUD process was created and intended <br />to allow for flexibility. He stated it allows for joint planning and looking at development on a <br />more comprehensive basis and that is why the parcel on the site was developed for interplay with <br />two uses. <br />Director Ericson stated that joint parking was intended in the development agreement, but it <br />cannot be documented in writing because the Walgreens owners do not agree. <br />Director Ericson stated that the Beltings would like some consideration from City Council <br />regarding this issue. He explained that the alternative to not being able to park in the Community <br />Center lot would be either to have a waiver of the additional seven stalls or an amendment to the <br />• PUD. He added that if these alternatives cannot be achieved, the Beltings would have to cut off <br />
