Mounds View City Council January 23, 2006 Regular Meeting Page 8 • Finance Director Beer reported franchise fees of $265,000 for the General Fund and $265,000 for the Street Improvement Fund are included in the 2006 budget. Finance Director Beer stated that if approved by the City Council, the ordinance will then be published in the New Brighton-Mounds View Bulletin and take effect 30 days after publication. Mayor Marty opened the public hearing at 8:14 p.m. There being no public input, Mayor Marty closed the public hearing at 8:14 p.m. Councilmember Stigney questioned staff if Xcel Energy is agreeable to remove the language in the ordinance regarding waiving fees for ensuing years. Finance Director Beer stated that it has not been discussed yet. Councilmember Stigney requested legal interpretation. City Attorney Riggs stated that the ordinance that goes into effect follows the franchise agreement and includes an agreement that the language can be taken out. He stated that this does not mean there might not be somewhat of an argument, but it is in control of the City. Mayor Marty stated this item was prepared a little late this year. Councilmember Stigney stated that once things take effect, sometimes it is kind of hard to correct i them. City Attorney stated that Finance Director Beer discussed the issue with Mark Vose and with Excel Energy. Mayor Marty stressed next year this item should be taken care of in the fall. Finance Director Beer stated that it is on his calendar for August 1, 2006. MOTION/SECOND: Gunn/Thomas. To waive the reading and adopt Ordinance 767, an Ordinance Implementing a Franchise Fee on Xcel Energy Electric and Natural Gas Operations within the City of Mounds View for the Year 2006.
