Mounds View City Council Apri114, 2008 <br />Regular Meeting Page 2 <br />Planner Heller explained the requested interim use permit for a temporary tent at Moe's <br />Restaurant. In 2006 a deck was built and last year they started using a tent out on that deck. <br />Staff had asked them to obtain an interim use permit to allow them to use the tent for up to 180 <br />days in a calendar year. With an interim use permit there are a few special requirements as part <br />of the approval process. Every time the tent goes up they will need to apply for fire permits and <br />the fire marshal will review and inspect with each permit. <br />Planner Heller noted that parking was reviewed when the deck was constructed and, since the <br />tent will only be used on the deck, Staff feels parking is adequate. <br />Planner Heller indicated that the tent size is limited to 5,000 square feet or 10% of building <br />square footage. Flanner Heller noted that this interim use permit can be reviewed by the City at <br />any time if there are any issues with the use of the tent at the site. Planner Heller indicated that <br />all City Code requirements are satisfied with this interim use permit request, and Staff <br />recommends approval and the Planning Commission unanimously recommended approval. <br />Hearing no public comment, Mayor Marty closed the public hearing at 7:11 p.m. <br />Council Member Mueller thanked Staff for the well written report and noted that she is pleased <br />that there have been no issues with Moe's previously. <br />MOTION/SECOND: Mueller/Hull. To Waive the Reading and Approve Resolution 7254, A <br />Resolution Authorizing An Interim Use Permit for a Temporary Tent at Moe's Restaurant, 2400 <br />County Highway 10. <br />Council Member Mueller asked whether Moe's would ever consider expanding the deck area <br />into more restaurant space. Mike Glazee, Manager at Moe's, indicated they do not want to take <br />the deck out of service, but have thought about that if the business continues to grow. <br />Mayor Many said that usually the Resolution from the Planning Commission comes to Council <br />identical but Number 2 is different, in that the Council Resolution does not list that the tent is <br />only to be located on the deck. <br />MOTION/SECOND: Marty/Mueller. To Amend the Resolution to Add in Number 2 that this <br />IUP is valid only to be located on the deck. <br />Ayes - 5 Nays - 0 Amendment carried. <br />Ayes - 5 Nays - 0 Motion as Amended, carried. <br />B. Resolution 7258 Consider an On-Sale Intoxicating Liquor License and <br />Restaurant License located at 2400 County Road H2 for Kevin Halverson <br />and David Tulgren (d.b.a. Robert's Sports Bar and Entertainment). <br />
