Mounds View City Council November 10, 2008 Regular Meeting Page 6 i Jim Kavanaugh, 7956 Red Oak, said that he has lived at his residence for 36 years and they are scheduled for a water garden but they look forward to it. He then said that Rice Creek does require that overall water needs to be handled, however, there is nothing that says it has to be in a certain location. There are people in the area that would be willing to have a garden rather than force it on those that do not want them. He then said that he feels it is poor public policy and bad community relations to force a rain garden on them when there are people willing to have them instead. Bob Glazer, member of the Streets and Utilities Committee provided photographs to the Council for review. He then said that he does not see how the rain gardens are going to work with barrier curbs. Joe Rhein indicated that moving one rain garden may require replacing it with two in another location. The rain gardens, as proposed, are designed to handle the required stormwater for this project. Valerie Amundsen said that this is the first of nine street projects so this establishes the city policy and practice going forward. She then said that if there is an appeals process available to people she would want to make sure that each individual case is heard and considered. She then said that this is a big deal to some people and she would hope that the City would take that into account. • Mayor Marry said that he would like to try working with the property owners in this case to come to agreement as best is possible. Council Member Mueller asked how many swale areas were identified. Joe Rhein indicated that there were 104 noticed. Council Member Flaherty commented that he was pleased that Ms. Pomper said that she did not like the rain garden in front and then asked if the City would consider using the sideyard because that shows that she is willing to work with the City. Council Member Hull asked whether the City would be liable for any water that fills a basement after the Swale is constructed. Joe Rhein explained that the Swale is designed to hold 12 inches of water and, if there is more than that, it backflows out to the street and flows down the street. MOTION/SECOND: Flaherty/Hull. To Waive the Reading and Approve Resolution 7352, Considering Appeals for the Stormwater Infiltration Program on the 2009-2010 Street and Utility Improvement Program as Amended to Move the Swale from the front Yard to the Sideyard. Council Member Stigney asked whether a sideyard swale would provide the same amount of water infiltration. Joe Rhein indicated that it should do so as long as the Swale will fit in the sideyard. Ayes - 4 Nays - 1(Mueller) Motion carried.
