f <br />MEMO TO: Mayor and City Council <br />FROM: Director of Public Works/Community Development <br />DATE: July 28, 1982 <br />SUBJECT: JIM PETROWSKI INFORMAL VARIANCE REQUEST FOR GARAGE SETBACK <br />Attached is a copy of Pages 1 and 2 of the Planning Commission <br />minutes of May 5, 1982. Mr. Petrowski appeared before the Planning <br />Commission during the "Residents Comments and Requests From the <br />Floor" portion of the agenda. <br />This item was further discussed with the Planning Commission at <br />their July 21, 1982 meeting. <br />The Planning Commission advised Mr. Petrowski that for them to grant <br />a variance he must show that his situation is unique and not self <br />caused. The Planning Commission came to a consensus that there were <br />other alternatives which should be evaluated prior to requesting a <br />variance, for instance, that he investigate the possibility of <br />redesigning the interior spaces of his house so that sleeping areas <br />were not on the County Road J side. The Planning Commission was <br />concerned as to whether the plan which he is proposing would do what <br />he wanted it to do, that is lessen the noise. They suggested that <br />Mr. Petrowski consult a builder to look at other building alterna- <br />tives which might achieve the same end. <br />Mr. Petrowski was told that he could apply for a variance and that <br />if the request was denied he could appeal the decision to the City <br />Council. They also suggested that he appear before the Council <br />during the citizen input part of the meeting and ask Council for <br />direction. <br />The Planning Commission attempted to inform Mr. Petrowski that there <br />may be other alternatives available to lessen the noise problem <br />that may not require construction of a garage only 18 feet from the <br />road right-of-way. Another area of concern discussed by the Planning <br />Commission was how granting of the setback variance might impact <br />other properties along County Road J and would the City be approached <br />with similar requests for setback variances. <br />Also attached is a c:,py of the results of the noise study conducted <br />as part of the Draft Environmental Impact Statement prepared for <br />New Trunk Highway 10, dated February 20, 1979. Noise receptor No. 3 <br />was located between Mr. Petrowski's home and Red Oak Drive. Noise <br />level monitored was L10 = 69 dBA and L50 = 57 dBA. Projected noise dBA <br />level for the year 2000 under the no build alternative is L10 <br />and L50 = 69 dBA. M.P.C.A. standards are daytime: L10 = 65 dBA and <br />L50 = 60 dBA; nightime: L10= 55 dBA and L50 = dBA. <br />1981 Ramsey County traffic flow data indicates an average of approx- <br />imately 13,000 vehicles per day travel the section of County Road J <br />
