MEMO TO: Mayor and City Council <br />FROM: Clerk-Administratory Paule}/' <br />DATE: July 6, 1983 <br />SUBJECT: BLOCK 1, IRON WORKS PLAT, ALLEY VACATION <br />Attached to this memorandum please find a copy of a letter with <br />attachments received by the office from Mr. John J. Berglund repre- <br />senting the owner of Lots 3 and 4 and the north 1/2 of Lot 5, Block 1, <br />Iron Works Plat, regarding the referenced subject matter. <br />As a matter of record, I would like for it to be known that the matter <br />relates to all of Block 1, Iron Works Plat and that my personal home <br />is located on the lot directly south of the one identified in Mr. <br />Berglund's letter. <br />The issue before you relates to a dedicated 14 foot alley right-of- <br />way or easement that was recorded along with the plat in the 1890's. <br />Somewhere along the line Ramsey County and City records were adjusted <br />to show the alley as vacated, however, Mr. Berglund's office, with the <br />assistance of City staff, has determined that no resolution was <br />adopted by the City ordering the vacation. It is a possibility that <br />the township ordered the vacation, however, we have no way of deter- <br />mining that fact. <br />It is my understanding that all of the property owners in the block <br />maintain their property as if the alley were vacated and that many, <br />if not all, of their up-to-date property records, including my own, <br />show that they have title to 1/2 of the 14 foot alley easement. The <br />City Attorney has recommended that the Council deal with this matter <br />as provided for by Section 12.06 of the City Charter which requires <br />a public hearing and adoption of a resolution to be filed with the <br />county for the vacation of an alley. <br />At the present time, staff finds no useful purpose for tha alley, <br />however, the utilities will be contacted to determine if an easement <br />is necessary. <br />RECOMMENDATION: Staff recommends the setting of a public hearing <br />for 7:40 p.m. on July 25, 1983 to consider the vacation of the alley <br />in Block 1, Iron Works Plat <br />DP/bc <br />Attachments <br />
