Bouton, <br />who is the fee owner of the following described property: <br />Lot 3, except the north 10 feet thereof; <br />f Lot 4; <br />The North 1/2 of Lot 5; <br />all in Block 1, Iron Works Plat, in Ramsey County, <br />Minnesota. <br />Mr. Bouton purchased this property from Eugene and Nicole <br />Tomas in November of 1979. Just prior to the purchase, it <br />was determined, however, that the legal description for the <br />alley in Iron Works Plat apparently had been forfeited to the <br />State for failing to pay taxes on the vacated alley. We required <br />that the sellers purchase from the State that portion of the <br />vacated alley which is contiguous to our client's parcel. That <br />conveyance was made and the transaction was closed. <br />The property is registered land and money was held in escrow <br />to complete a proceeding subsequent to bring onto the Certificate <br />of Title that portion of the vacated alley which was purchased <br />from the State. Once we commenced the proceeding subsequent, <br />it was determined that in fact the alley has never been vacated, <br />that apparently the forfeit to the State was improper. <br />The Ramsey County half section sheet shows the alley as vacated, <br />the City shows the alley vacated, however, there is absolutely <br />no resolution that caused the vacation in the first place. We <br />have searched the records of the other lots which would benefit <br />from the vacation, and we can find no evidence that the alley <br />was ever vacated. <br />
