DEVELOPMENT <br />Attached for your review and adoption is wolution No, IG25 approving <br />the final plat fur the subdivision of Lot 2, Block 3, Programmed Land. <br />The Council, in approving the preliminary plat, required approval from Rice <br />Creek Watershed District and also required the developer to submit record - <br />to documents for the drainage to the City. Although a written permit has <br />not been received from the Rice Creek Watershed District, staff contacted <br />Rice Creek Watershed District and the permit was approved at the June 22nd <br />meeting. In addition, the developer has submitted a document which <br />describes the drainage. easement as required by the City. Staff has <br />has not ye[ reviewed <br />reviewed the description and it covers thearcu required. The City Attorney <br />review the docummennttprior this document. Staff will attempt to have the attorney <br />to your Monday meeting. The developer has not <br />submitted the actual final plat drawing. The Council could approve this <br />Plat and staff will verify its accuracy to the preliminary plat when it is <br />submitted. <br />Also attached is Resolution No. 1626 executing the development agreement <br />for the motel project. Please note item 3 in Exhibit 2A which states that <br />the building must be sprinkled. The possibility exists that a permit for <br />the motel could be taken out prior to when the ordinance requiring <br />sprinklers goes into effect. The second reading of this ordinance is also <br />on this Monday's agenda. The ordinance would then take effect July 30 (30 <br />days following publication). The Council should discuss whether they want <br />this motel to be sprinkled. If so, language in Exhibit 2A should remain in <br />the event that a permit is taken out prior to July 3U. <br />RECOMMENDATION: Adopt Resolution No. 1625 if the attorney has reviewed the <br />easement document and Resolution No. 1626 following review of item 3 on <br />Exhibit 2A of Development Agreement No. 83-61. <br />FJK/bc <br />Attachments <br />
