MEMO TO: Clerk -Administrator and City Council <br />FROM: Director of Public Works/Community Development <br />DATE: May 10, 1983 <br />SUBJECT: BABINSKI REZONING, SUBDIVISION AND DEVELOPMENT <br />Attached please find Planning Commission minutes of May 4, 1983, <br />Planning Commission Resolution No. 76-83, staff report and site plan <br />for the proposal by Mr. Leonard Babinski to: <br />1) Resubdivide the property under consideration from 16 lots <br />into 12 lots. <br />2) Rezone the 12 lots from R-]., Single Family Residential to <br />R-3, Medium Density Residential. <br />3) Construct twelve 4-unit buildings upon each of the newly <br />resubdivided lots. <br />Key issues relating to this development include: <br />1) Density relationships between the Comprehensive Plan and <br />Zoning Code (see discussion below). <br />( <br />2) Major subdivision is required since a changing of property <br />lines is being proposed and the property is more than two <br />acres in size. <br />3) The possibility exists that the force main which is presently <br />on the east side of Edgewood will be phased out of service <br />sometime in the future. For this reason, a 15 foot easement <br />along the west property lines was required for possible <br />future installation of a gravity main. <br />4) Staff suggested that the Planning commission consider the <br />requirement of installation of curbing on Edgewood and Bronson <br />drives for traffic control purposes (see "parking #3" on <br />planning report). The Planning Commission did not concur with <br />this suggestion. <br />5) The conditions of Ordinance No. 49A have been met. <br />6) Setbacks, parking and open space requirements have been met. <br />7) The application has been submitted to Rice Creek Watershed <br />District for approval. Staff has not received a permit from <br />Rice Creek Watershed District to date. <br />There was considerable discussion amongst the Planning Commission <br />members as it related to the Comprehensive Plan versus Zoning Code <br />designations for Medium Density Residential.
