.10- <br />' lV <br />(4) Enforcement Authority. The Administrative Authority is <br />aut or�a co post a cease and desist order upon land which has <br />had a permit revoked or to post a cease and desist order upon <br />land which is currently undergoing any activity in violation of <br />this ordinance. A copy of each cease and desist order will be <br />sent to the City Attorney for the City of Madison. <br />These orders shall specify that the activity must be ceased <br />or hreught into compliance with the ordinance within seven (7) <br />days. Any revocation, or cease and desist order shall remain <br />in effect unless retracted by the Administrative Authority, <br />Board of Public Works, or by a court of general jurisdiction; <br />or until the activity is brought into compliance with the <br />ordinance. <br />37.10 VIOLATIONS. <br />1 Penalties. Any person, firm, company or corporation, either <br />owner or occupant <br />of the premises, who fails to comply with any <br />of the provisions <br />of this ordinance, shall he subject to a <br />forfeiture of not less than $20 nor more than $200 and costs of <br />prosecution for each violation. Fich day that a violation <br />exists or continues shall constitute a separate offense. <br />(2) Fnforcement b In' unction. Cempliance with the provisions of <br />t fs orainance may also oe enforced by injurctional order at <br />the suit of the City of Wison. <br />(3) Performance of 1Vork by the Administrative Authorit . <br />a is ere tt is toua tat any of the provisions o this <br />ordinance are not being observed on particular lands, the <br />Administrative Authority is hereby authorized to require <br />the owner, occupant or user to perform the work or land <br />treatment measures within ten (10) working days and to <br />order that if the owner, occupant or user fails to perform, <br />the Administrative Authority may go on the land, and bring <br />the condition of said lands into conformity with the <br />requirements of this ordinance, and recover the costs and <br />expenses thereof from the owner. In the event that the <br />owner fails to pay the amount due, it shall be collected as <br />a special charge for current services rendered upon the <br />property as provided by law. <br />37.11 APPEALS. <br />Ti--Authority. The Board of Public Works shall: <br />a ear and decide appeals where it is alleged that there is <br />error in any order, regirement, decision or determination <br />made by the Adminstrative Authority in administering this <br />ordinance. <br />(b) Authorize upon appeal in specific cases such variances from <br />the terms of this ordinance as will not be contrary to the <br />public interest, where owing to special conditions a <br />literal enforcement of the provisions of this ordinance <br />will result in unnecessary hardship, so that the spirit of <br />this ordinance shall be observed, public safety and welfare <br />secured, and substantial justice done. <br />4 <br />
