RESOLUTION NO. 1612 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT, <br />MINOR SUBDIVISION, WETLANDS ALTERATION PERMIT <br />AND DEVELOPMENT AGREEMENT NO. 83-59 FOR TONY POPPELAARS <br />WHEREAS, Tony Poppelaars has submitted plans for the <br />approval of a 10 unit apartment building with accompanying parking <br />facilities to be located on Lots 1 and 2 of Block 2, Park View <br />Terrace; and <br />WHEREAS, the proposed development area lies within a designated <br />wetland zoning district as delineated on the wetlands Zoning District <br />Map; and <br />WHEREAS, per Chapter 48.05, no development shall be allowed <br />within a wetland zoning district without first having obtained a <br />wetland alteration permit from the City; and <br />WHEREAS, the proposed development area also lies within a <br />designated flood plain; and <br />WHEREAS, since the applicant is proposing to fill a portion <br />of the flood plain as a result of the proposed, aconditional use <br />permit is required; and <br />WHEREAS, in order for the developer to receive wetland <br />credits as outlined in Chapter 48, a minor subdivision to combine <br />the two lots under consideration into one is required; and <br />WHEREAS, the Planning Commission has reviewed this develop- <br />ment proposal and has recommended approval with conditions by <br />adopting Resolution No. 75-83; and <br />WHEREAS, the City Council has also reviewed this development <br />proposal and its application to the Municipal Code, specifically <br />Chapter 40, 42, 48, and 49; and <br />WHEREAS, a public hearing was conducted on May 23, 1983 to <br />receive comments from all interested persons; <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City <br />Council grant the following: <br />1. A conditional use permit to allow the filling of a <br />portion of the flood plain as shown on the site plan <br />identified as Exhibit 2 of the development agreement. <br />
